FOR AND IN CONSIDERATION of permission to connect a dwelling
erected and future buildings to be erected upon the premises hereinafter
described to the water and sewer systems of the City of Bozema.n, Montana,
the undersigned, for and on behalf of themselves, their heirs, executors,
administrators and successors in interest, do hereby covenant, agree ar'd
consent to include the hereinafter described property situate in the
County of Gallatin, State of Montana, within the city limits and bound-
aries of the City of Bozeman, Montana, upon the request of the City
Commission of the City of Bozeman to annex the same thereto.
A tract of land in the SEt of the NWt of Sec. 12, T2S, R5E, M.P.M.
City of Bozeman, Gallatin County, Montana.
Beginning at a point which bears N 890 47' 30" E along the south
line of said SE~ of the NWf;: a distance of 170.3 feet and N 10 U' 30" E
a distance of 30.0 feet from the S.E. corner of the SEk of the Nwk of
said Sec. 12, thence from said point of beginning and bearing N 10
14' 30" E a distance of 232.35 feet to a point On the south property
line of West Main Street, thence S 890 41' W along said south property
line a distance of 106.90 feet, thence S 20 13' 30" W a distance of
232.28 feet to a point on the north property line of West Babcock Street,
thence N 89- 47' 30" E along said North line a distance of 11'J.91 feet
to the point of beginning, containing O.5l) acres, more or less.
The undersigned, further covenant and agrees to pay to the City of
Bozeman, Montana, prior to making of said sanitary sewer and water
connections the normal tie-on fee, being sixty-five ($65.) dollars for
the sanitary sewer connection from the main to edge of easement and a
charge of Ninety-five ($95.) dollars for the 3/4" water line tie-on for
the first fifty feet plus $2.00 per foot of the balance of the distance
to the meter.
The undersigned further covenant and agree to pay a proportionate
share of the cost of construction of water and sewer mains which may be
I constructed to make water and sewer service available to the <'lbove
described property at some future date.

while in regular session. the City Commission of the City of
Bozeman did approve and accept the within utility agreement between
the City of Bozeman and Marguerite Kirk.
