HomeMy WebLinkAboutDraft subdivision MOU transmittal 6-6-18 MEMORANDUM TO: Planning Coordination Committee FROM: Chris Saunders, City of Bozeman Community Development Manager RE: Draft Memorandum of Agreement regarding subdivision review standards between Gallatin County and City of Bozeman DATE: June 6, 2018 Following up from discussion at previous PCC meetings, the Gallatin County and City of Bozeman planning staff have prepared an initial draft for discussion. The draft follows the format of the previously approved agreement between Gallatin County and the Town of Manhattan regarding subdivision review. The agreement has been modified to reflect the needs of the two parties. Staff seeks feedback from the PCC on the general direction of the draft MOU. There are several questions needing further investigation. However, before moving to the fine detail we would like to understand such broad concerns as may exist. Questions requiring additional work include: Section 1 - Definitions Section 1, paragraph E – How does this definition interact with subdivision and zoning standards and under what circumstances will a non-subdivision development be affected by this agreement. This section interacts with Section 6, paragraph C that recognizes the County’s zoning standards. Section 1, paragraph I – The City of Bozeman staff will prepare a document which includes the appropriate citation and full text of those standards included in this definition. This will provide a basis for discussion prior to any action by the County to amend subdivision regulations. Section 1, paragraph K – This definition is important in establishing the criterion for when the County will direct landowners to seek annexation prior to development. The present proposed residential standard is roughly equal to the existing RS district in the Gallatin County Bozeman Area Zoning District. Section 1, paragraph L – A number needs to be established for the outer boundary of the urban growth area. Initial discussions had considered 1,500 feet as a beginning point. There is some concern that this is only about three City blocks in size and may be too small to effectively address the concern. The draft definition says that the urban growth area would apply to the entirety of any tract wholly or partly included in the defined distance. As written, the area of the urban growth area will adjust outwards without any formal action. As the City completes an annexation the City boundary will move and the urban growth area will expand an equal amount. A hardcopy map will be provided from time to time for convenience. An example map is attached to this memo. If the distance included in the MOU is changed the map will likewise be updated. Section 7 – City Planning Section 7, paragraph A – Additional time is needed to discuss this language with the Road and Bridge Office and Public Works to ensure that those who will carry out this provision understand its meaning and can make it work. Staff will continue work on the questions above after receiving PCC feedback on the draft document. A revised draft will come back to the PCC before going to each of the participating Commissions for consideration. attachments: draft Memorandum of Understanding draft Exhibit A map
