EASEMENT AND RIGHT-OF-WAY AGREEMENT FOR SANIT~Y SEWER

BOZEMAN, a municipal corporation of the State of Montana, in Gallatin County,
the party of the second part, hereinafter called the Grantee.
WIT N E SSE T H :

of the Grantor--J said easement and right-of-way to consist of a strip of land

Beginning at a point on the westerly lot line of lot 32 Block 28, Northern
Pacific Addition said point being~ feet northerly of the southwesterly
corner of said lot 32; thence easterly parallel to and 'Ph feet distant from
the southerly lot lines of said lets 32-31-30-29 and 28 a distance of 124
feet; thence northerly parallel to and 1 foot distant westerly from the
easterly line of said lot 28 ~,distance of'6 feet; thence westerly parallel
to and 100 feet distant northerly from the southerly lines of said lots 28
thru 32 a distance of 124 feet; thence southerly along the westerly line of

ances and privileges unto the said Grantee and to its successors and assigns
forever"
The Grantee hereby covenants and agrees with the Grantor_ as follows:
L, That, in connection with the installing, operating, using, repairing,
replacing, maintaining and removing of ,said 8" sanitary sewer la.teral
it will replace, at its sole expense" all existing fence,s, ditches and other
appurtenances of said land that may be distunDed by its operation in a cond-
ition equal to the conditionthereofexiating before said operations were
begun, or as near thereto as shall be reasonably possible.
2. That, during operations involving excavation, it will remove the top-
soil from the trench area to a depth of one foot, or to the full depth of
the topsoil, whichever is less, and stockpile'said topsoil aWAY from the
site any large rocks or surplusexoavated material or any kind of the site
any large rocks or surplus excavated material or any kind of debris that
may ha,ve been -exposed by the excavation and remaining after baokfilling is
completed, and will leave th~ ,finished surface in substantially the same
condition that existed prior 'to the'beginning of o.perations except that the
surface of backfilled ar~ may be mounded sutficl~ntly to prevent the
formation of depressions after final settlement has taken place.

depth below the surface of the earth as will permit normal cultivation of

manner as will not hinder or prevent the proper cultivation of the tract
through which this right-of-way is hereby granted.

60 In the event that it should become necessary for the Grantee to re-
enter the Grantor_premises for t.he purpose at repairing, replacing, main-
taining or removing 8ft sAnitarY sewer l~teral line,'t.he Grantee will
reimburse the Grantor_ for any actual. damage _done to the Grantor_ premises
