Box 1230 Bozeman,MT 59771-1230 RE: Objection to zoning change for Lots 1 and 6, Kagy Crossroads Minor subdivision, Bozeman, Montana Dear Commissioners, a Please accept this letter as Stockman Bank's objection to the Zone Map Amendment application to rezone the above described real property from B-2 Community Commercial to B-2M Community Commercial Mixed. Stockman Bank owns approximately 2.42 acres of land located at 1815 S. 19th Ave., legally described as Kagy Crossroads Sub, S14,T02 S, R05 E, Block 1, Lot 4—5. The Stockman property is adjacent to the subject property, as illustrated on the attached diagram. Stockman operates a full service branch bank on the property and provides drive-through banking services and parking for its customers and employees. Stockman's property is separated from the property proposed for rezoning by a narrow, two-lane roadway which provides no space for parking. Stockman believes that the B-2M zoning designation's reduced parking requirement for residential use will cause spillover parking onto the narrow roadway and onto Stockman's property. This concern is borne-out by the Staff Report for the proposal which clearly states as follows: There are very different parking standards between the B-2 and B-2M districts with B-2M having the less rigorous standard. The B-2M district requires half or less of the parking required in B-2. The placement of the isolated two lots of B-2M in the center of an existing largely developed B-2 area creates the possibility of spillover parking onto adjacent properties. This increases the likelihood of conflict between adjacent landowners. I8-132 Staff Report for the Kagy Crossroads Zone Map Amendment,p. 14. The immediate area has been developed to the parking standards of B-2. Those standards are working well for all. Each property owner provides the necessary parking to serve their own needs and does not rely on other owners for their parking needs. The area does not provide public parking, nor are the streets sufficient for on street parking. Therefore, rezoning the subject property to B-2M Community Commercial Mixed will only create parking issues. Accordingly,we request that the Commission deny the proposed amendment to change the zoning for Lots 1 and 6,Kagy Crossroads Minor subdivision to B-2M Community Commercial Mixed.
