Parks - Kagy Crossroads Zone Map Amendment OwAfte 400 Marion, Inc -1A ye!- PO BOX 206,Bozeman,MT 59771 (406) 530-6132 Regarding: File 18-132 Kagy Crossroads Zone Map Amendment Dear City Commissioners, 400 Marion, Inc.owns a professional commercial building at 1819 S.22"d Avenue/Unit D-1 of Kagy Village Condominiums located on Lots 1 and 2 in Block 2 of Correction Plat of Kagy Crossroads Subdivision. Our property is located just to the West of the proposed Zone Map Amendment and we agree with the city's planning department that opposed this ZMA. We are opposed to this amendment for the following reasons: 1.) The proposed Zoning change would benefit only one property owner. Only one. While the proposed zoning change from B2 and subsequent development(under proposed 132M)would likely create a greater burden on many adjacent property owners. 2.) The city staff report found the proposed zoning conversion is not in character with the existing development. • The Growth Policy calls for activity in this area to provide"employment and services to the greater community". Changing the zoning to allow greater residential usage,and reducing parking requirements will hamper further development of these uses in this area as employers and consumers will avoid developments that lack sufficient parking. • It appears that the applicant is a Student Housing developer which we feel will be a disruption in use of the adjoining professional offices at S. 19th/Stockman Way(Stockman Bank, Bozeman Broker Group, Bioscience Laboratories)and the Kagy Village professional offices located to the west of S.22°d Avenue(LexisNexis, Billings Clinic, Pure Dermatology, IRS, US Fish Wildlife and Parks etc.). 3.) The proposed zone change also appears to reduce the parking requirements. With a Student Housing project of this size, parking and traffic will be a constant issue. Even if we assume that many of the occupants will not use their cars on a daily basis(which seems to be the promotion of most high density residential developers in town),there will still be substantial pedestrian and bicycle traffic issues. Namely the crossing of South 19th Avenue. The crosswalk at South 19th and Lincoln is extremely dangerous and a major accident waiting to happen. If pedestrians choose to cross at South 191h and Kagy, the traffic disruptions to these main arterial roads will be a nightmare. For a preview of this type of congestion,one needs to watch the smaller intersection of South 11th and Kagy as students head to and from the Stadium View Apartments. We are hopeful that this site is developed and a traditional mixed use project that fits within the B-2 zoning is acceptable to us. However,it appears that this ZMA request is to minimize the amount of parking necessary while maximizing the amount of housing units. All the best Jason Parks 400 Marion, Inc.
