SUBJECT: Authorize the Mayor to execute the Project Funding and Maintenance Agreement with Montana Department of
Transportation (MDT) for the Transportation Alternatives Program
Projects to take place this summer.

RECOMMENDATION: Authorize the Mayor to execute the Project Funding and Maintenance Agreement with the Montana Department of Transportation (MDT) for the
Transportation Alternatives Project to take place this summer.
BACKGROUND: MDT has an annual, competitive grant program which funds improvements to bicycle and pedestrian facilities across the state, the Transportation Alternatives (TA) Program. In 2017 the City of Bozeman applied for and was awarded (TA) funding for
improvements to the pedestrian and bicycle infrastructure in our city. We were successful in
obtaining funding for two projects, described as follows: 1) Construct ADA compliant sidewalks
along the east side of North 7th Avenue from just north of Griffin Drive southward to just beyond Nickles Drive and along the west side of North 7th between Mandeville Drive and Wheat Drive and 2) Perform pavement restoration (patching and fog sealing) and ADA
upgrades at several locations, to wit, the Highland Boulevard Path along the west side of
Highland Boulevard between Main Street and Kagy Boulevard, the South 19th Avenue path
along the east side between College Street and Lincoln Avenue, the Gallagator Trail from the east side of the Library to South Church Avenue , the College Street Path on the south side between South 11th Avenue and South 29th Avenue, and the Oak Street Path along the south
side between Rouse Avenue and 5th Avenue. The work is scheduled for this summer. In order to
obtain the funding, we are required to execute the attached agreements. The agreements detail
both our funding requirements and maintenance responsibilities with respect to these projects.

These agreements have been exhaustively reviewed by the legal department as well as by the
Engineering Division, hence we are recommending entering into this agreement.
UNRESOLVED ISSUES: None.
FISCAL EFFECTS: The City's financial responsibilities amount to paying a matching share
(13.42%) and committing to pay MDT's indirect costs in the event of cost overruns. Our
estimated match (the final amount won't be known precisely until the bid is awarded) is
$51,419.00. The indirect costs are assessed for any additional engineering and inspection costs attendant to the overrun and are currently assessed at 10.96%. The city has sufficient street
maintenance funds available for this work.
