5 A.1.1&uaranteed Maximum Price
Pursuant to Section 2.2.6 of the Agreement, die Owner and CODAI-LICdon Manager hereby
amend the Agreement to establish a Guaranteed Maximum Price.As agreed by the Owner
and Construction Manager, the Guaranteed Maximum Price is an amount that the Contract
Sum shall not exceed. The Contract Sum consists of die Construction Manager's Fee plus
the Cost o f the Work, as that term is defined in Article 6 o f this Agreement.
A.111 The Contract Sum (No. 6) is guaranteed by the Construction Manager not to exceed
one hun(tred -ty-tivo thousand seven hundred thirty-eight dollars and 05 cents,
($142,738.05), for 11) Bid Add Alternate No. I for additional paving ("Exhibit U of
Attachment "B"); and 2)storni sewer extension for a total contract sum of four
million seven hundred eight thousand four hundred one dollars and 05 cents
($4,708,401.05) Subject to additionsand deductions by Change Order as provided inthe
Contract Documents.

Re: Bozeman Sports Park Accept Additive Alternate Parking lot and Storm Drain Piping/Structures for
Synthetic Turf Fields,GMP Amendment##7 Request
Dear Carolyn,
As per our agreement for the Bozeman Sports Park Project,we are requesting Amendment#7 to accept the i
additive alternate in the Site Hardscape package for the north half of the parking lot and to incorporate the
storm drain system for the synthetic turf fields into this project. This amendment is in the amount of
$142,738,05. The amended GMP total would be$4,708,401.05. Please reference exhibit"A"for a
breakdown on how we derived our proposed amendment.
The contingency for this amendment is estimated at$6,750 which is estimated at approximately 5%of the
construction cost for the above referenced scopes of work. Contingency will be utilized per the AIA
Document A133-2009 agreement between the owner and Construction Manager.
We have reviewed the bids submitted for the synthetic turf storm drain, H and H Earthworks is the low
responsible bidder. With the addition of the synthetic turf fields acceptance of the parking lot additive
alternate is needed. CMG Construction LLC is contracted to perform the parking lot base bid and their
previous submitted alternate value is reasonable.
We have the following clarifications as per section 2.2.3 of our contract:
1. We acknowledge the attached of drawing(exhibit B). Bid results(exhibit C)
2. Our clarifications and assumptions in regards to our GMP as follows.
a. This GMP is only for incorporating additive alternate parking lot gravel/paving and the
portion of the storm drain system need for the synthetic turf.
b. Additional phases and scope will cause amending our agreement at a later date.
c. DAC has not included any allowances in our GMP.
d. Testing services shall be contracted separately by the owner.
e. As per section 3.7.1 of the contract the owner shall secure and pay for the building permits
and fees as well as for other permits,fees, licenses,and inspections by government agencies
necessary for proper execution and completion of the work that are customarily secured

after execution of the contract and legally required at the time bids are received or
negotiations concluded.
f. There is no general condition cost in our spreadsheet as this work will be completed during
other scopes of work currently under contract. Additional general condition costs will be
added as scope from other trades are added to our contract.
3. Our proposed GMP as per exhibit A is$142,738.05. Please reference the spreadsheet exhibit A for
a breakdown of the bid package cost, contingency and construction manager fee. Scope of work
contained in the bid packages for site improvements phase 1A 2018 can be found in the project
manual under instructions to bidders and attached revisions.
4. The anticipated date of substantial completion is November 1, 2018
5. Our GMP 47 must be accepted and approved by May 16, 2018 for the above to become valid.
