Amendment 3 with TD&H for Engineering Development Review Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Shawn Kohtz, Development Review Engineer Craig Woolard, Public Works Director SUBJECT: Authorize the City Manager to sign Amendment No. 3 to the Professional Services Agreement with TD&H Engineering for Development Review Services. AGENDA ITEM TYPE: Consent MEETING DATE: May 21, 2018 RECOMMENDATION: Authorize the City Manager to sign Amendment No. 3 to the Professional Services Agreement with TD&H Engineering for Development Review Services. BACKGROUND: In March 2014, the City of Bozeman published a Request for Proposals (RFP) for development review services. These services include review of site plans, subdivisions, and other various private development applications received by the Department of Community Development. With the departure of Public Works Director, Craig Woolard, Development Review Engineer, Shawn Kohtz, has been assigned Acting Director. This leaves a substantial gap in the amount of support Shawn can provide for development review. Until a new Director is hired, TD&H will provide that support. UNRESOLVED ISSUES: None. FISCAL EFFECTS: The contract extension continues the billable rates agreed upon in the 2014 contract. The funds for this work will come from the Engineering contracted services budget. ALTERNATIVES: As suggested by the City Commission. Attachment: Amendment No. 3 to Professional Services Contract Report compiled on: May 10, 2018 230 1 Amendment No. 3 to Professional Services Agreement For Development Review Planning/Engineering Term Contract THIS AGREEMENT is made as of this 10 day of May, 2018, between THE CITY OF BOZEMAN, a Municipal Corporation, Bozeman, Montana, herein referred to as OWNER and TD&H Engineering, 234 E. Babcock St., Ste. 3, Bozeman, MT 59715 , an Engineering Consulting Firm of Bozeman, Montana, herein referred to as ENGINEER. WHEREAS, the parties have entered into a Professional Services Agreement dated April 18, 2014 , herein referred to as Original Agreement for professional engineering services; and WHEREAS, the parties desire to further amend the provisions of this Agreement. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the parties agree as follows: This agreement will, upon mutual agreement, be extended for a period of one year by written agreement of the Parties. In no case, however, may this agreement run longer than FIVE years. Except as specifically amended herein, the original agreement shall remain in full force and effect and the Parties shall be bound by all terms and conditions therein.
