FROM: Rick Hixson, City Engineer SUBJECT: Authorize the City Manager to execute the Memorandum of Agreement (MOA) with Montana Department of Transportation
(MDT) for maintenance of sidewalk, landscaping & irrigation equipment installed as part of the Blackmore Bend Development Project on East Main Street. AGENDA ITEM TYPE: Consent
MEETING DATE: May 21, 2018 RECOMMENDATION: Authorize the City Manager to execute the Memorandum of
Agreement with the Montana Department of Transportation (MDT) for maintenance of sidewalk, landscaping and irrigation equipment being installed as part of the Blackmore Bend Development Project. BACKGROUND: Improvements to the intersection of East Main Street are being installed in
conjunction with the Blackmore Bend Development. In order to obtain approval from MDT for these improvements, the City is required to execute the attached agreement. The agreement details the City's responsibilities with respect maintaining sidewalks, landscaping and irrigation infrastructure installed in MDT right-of-way. The agreement has been exhaustively reviewed by the legal department as well as by engineering. The responsibilities detailed are identical with
activities we are already performing, hence we are recommending entering into this agreement. UNRESOLVED ISSUES: None. FISCAL EFFECTS: The fiscal effects of entering into this agreement will be minimal. The
adjacent sidewalks, landscaping and irrigation infrastructure are elements which are maintained by the adjacent private property owners. ALTERNATIVES: As suggested by the City Commission.
