THIS INDENTURE, Made the ~.~/day of October A. D. 1960,
between BOZEMAN DEACONESS HOSPITAL, a Montana corporation, having
its principal place of business at Bozeman, Gallatin County,
Montana, party of the first part, and the CITY OF BOZEMAN, a munici-
pal corporation of the State of Montana. in Gallatin county, party
of the second part;
WITNESSETH: That the said party of the first part, for and
in consideration of the sum of One Dollar and other valuable con-
sideration ($1..00 ovc) to it in hand paid by the said..pax.t~-~,t.he-~-
second part, the receipt whereof is hereby acknowledged, has
granted, bargained, sold and conveyed, and by these presents does
grant, bargain, sell and convey, unto the said party of the second
part, and to its successors and assigns, a perpetual easement and
right of way for the purpose of installing, operating, using, re-
pairing, replacing, maintaining and removing a sanitary sewer out-
fall line across part of the Southeast Quarter (SE~) of Section
Seventeen (17), Township Two (2) south, Range Six (6) East, M.P.M.,
situated in Gallatin County, Montana, which easement is twenty feet
(201) in width, being ten feet (101) on either side of the follow-
ing described centerline, to-wit:
Beginning at the Northwest corner of the south-
east Quarter (SE~) of Section Seventeen (17),
Township Two (2) South, Range Six (6) East,
M.P.M., said Northwest corner being the center
of said section 17; thence North 89058130" East
on the north line of said Southeast Quarter,
a distance of 291.13 feet, being on thp nor:th~E:!:Y___~____._
boundary line of a tract of land described and
recorded in Book 135 of Deeds at pages 280-282,
in the office of the Clerk and Recorder of Gallatin
County, Montana; thence South 520541 East on an
easterly boundary line of said tract of land, a
distance of 161.20 feeti thence South 28043' East
on an easterly boundary line of said tract of land,
a distance of 122.00 feet to the point of begin-
ning of the centerline of said easement being
conveyed herein; thence North 590211 East on the
centerline of said easement a distance of 220.00
feet more or less to a point of terminus, said
point being the center of an existing natural
water course bearing in a northwesterly direc-
tion;
(The consideration for this conveyance is less than $100.00 and as
such requires no revenue stamps)

Together with the perpetual right of ingress and egress to and
from the above described real property at all reasonable times for
the purpose of installing, operating, using, repairing, replacing,
maintaining and removing said sanitary sewer outfall line and the
appurtenances thereto;
TO HAVE AND TO HOLD the above described easement with all the
appurtenances and privileges unto the said party of the second part,
and to its successors and assigns, so long as the easement herein-
before described is used as an easement for a sanitary sewer outfall
line, provided, that if at any time the use of the sanitary sewer
