Section 76-2-402.” (Other than conducting a public hearing, no official motion is required by the City Commission). Report Date: April 27, 2018 BACKGROUND: The Bozeman School District has submitted a site plan application to build the second Bozeman High School located at 4455 Annie Street. The District is claiming agency exemptions from compliance with certain zoning standards under Montana Code Annotated (M.C.A.) Section 76-2-402. The development proposed will not meet six municipal zoning standards required in the Unified Development Code, Article 38 of the Bozeman Municipal Code. Montana law (M.C.A. Section 76-2-402) addresses the relationship of municipal zoning regulations to a school district’s use of land. The law requires a public hearing whenever land is to be used contrary to zoning regulations. The statute expressly provides that a municipality “shall have no power to deny the proposed use but shall act only to allow a public forum for comment on the proposed use.” The requirement for a public hearing before the City Commission on such exemptions was specifically included in the 2012 Interlocal Agreement executed between the School District and the City. In this regard, the School District is claiming exemptions to the Bozeman Municipal Code for: 1. Sec. 38.25.040 Zoning designations do not permit off-site parking, for commercial parking use, including PLI zoning. There will be one to two events per year that the High School would require parking beyond those provided on site, the calculation takes into account that attendees will park on adjacent local streets (Flanders Mill and Annie). In event of a regional track meet (possibly once every two or more years) on-street parking on Annie Street and the use of Meadowlark Elementary School parking areas would be utilized. 2. Sec. 38.26.050.C Parking Lot Landscaping - requires that parking lots with more than 15 spaces shall have a minimum of 20 square foot of landscape area within the parking lot for each parking space in the lot. It remains the Bozeman School District’s policy to provide uninterrupted paved areas within all school parking lots. This practice has been endorsed by the Bozeman Police Department. 3. Sec. 38.26.050.C.2.a.(1) Mandatory Landscape Provisions - requires parking lot screening (when adjacent to residential areas) with 4’-6’ high fence or shrub. The parking lots at the new High School will be more than 50’ from the public way and screened with 3’ high berms and tree groupings. The height of the berms on the site are restricted to 3’ due to security concerns. 4. Sec. 38.26.050.E.3 Mandatory Landscape Provisions - requires that street trees be provided in the public right-of-way. The required quantities of street trees have been provided at the streets surrounding the school site (Cottonwood Road, Oak Street, and Flanders Mill Road). The proposed trees have been placed outside of the public right-of-way to allow the tree roots to grow without damaging to the asphalt paths. Annie Street between Cottonwood Road and Flanders Mill Road is internal to and bisects the school site. The number of trees proposed does not meet the number required due to the limited space available. 5. Sec. 38.26.050.I Mandatory Landscape Provisions - Irrigation Standards requires that all landscaped areas be provided with permanent irrigation. The site will include several areas of non- irrigated native grass, to reduce water consumption. Seeding will be timed to take advantage of nature’s wet cycle. All other landscaped areas will receive permanent irrigation. 6. 38.26.060 Landscape Performance Standards - The landscape points are to be earned with the installation of drought tolerant species for 75% or greater of the number of trees and shrubs. Providing one percent increments of lot area when covered by publicly accessible pedestrian facilities and features such as plazas, courtyards, seating areas and outdoor recreation facilities Following the public hearing, Staff will complete the site plan application review process with the Development Review Committee and prepare a staff report for consideration by the Director of Community Development. Standard public noticing procedures for the site plan application were conducted concurrently with the Agency Exemption Public Hearing noticing. UNRESOLVED ISSUES: As identified by the City Commission. FISCAL EFFECTS: None identified. ATTACHMENTS: Applicant’s submittal materials 217 New Bozeman High School SITE PLAN PROJECT NARRATIVE CIVIL NARRATIVE Introduction In 2017, a bond was passed to construct a new high school in Bozeman, Montana. During the pre- bond analysis period, the Bozeman School District #7 (District) selected a site for the new school on the northwest side of Bozeman. The selected site consists of two tracts located between Cottonwood Road, Flanders Mill Road, Durston Road, and Oak Street. The legal description for the two tracts are as follows: 1. Tract 1A2 of COS 2554B (36.896 acres), Section 3, Township 2 South, Range 5 East 2. Tract 2A of COS 2554A (42.935 acres), Section 3, Township 2 South, Range 5 East The two properties are split by Annie Street which runs east/west through the project site at approximately the midway point. The property north of Annie Street (Tract 1A2) will contain the new high school building, associated parking lots/access drives, two practice fields, and tennis courts. Currently existing on the property to the south of Annie Street (Tract 2A) is Meadowlark Elementary School (approximately a 10-acre campus). In addition, a competition track complex, softball fields, and comfort station will be located south of Annie Street. Development of this site will be completed in a single phase starting in the spring of 2018 and being ready for occupancy in the fall of 2020. The design population of the proposed high school is 1,500 students. Four new structures are planned for the project site; a three-story 300,239 SF high school including a 2,500 seat competition gymnasium, 2 auxiliary gymnasiums and a 750 seat auditorium, a one- story 1,271 SF maintenance building, a one-story concessions building, and a 2,255 SF track storage facility. Transportation and Parking Due to the considerable amount of traffic created by a new high school, a traffic study has been prepared for the project to inform decisions about on-site access/circulation, and offsite infrastructure capacity. The traffic study is provided herein and provides analysis of anticipated street impacts and recommendations for transportation facilities in and around the new high school site. Proposed offsite improvements adjacent to the new high school include construction of Cottonwood Road and Oak Street along with a roundabout at their intersection as shown in the 2017 TMP. A public Streamline bus stop on Oak Street near the north entrance of the high school is proposed. Flanders Mill Road was recently reconstructed to the local street standard as part of the neighboring development to the east. With development of Flanders Mill Road, the adjacent Maynard Border Ditch overflow is being relocated. All off-site improvements that are part of this project will be designed and constructed in accordance with applicable City of Bozeman Design Standards and Montana Public Works Standard Specifications. 218 New Bozeman High School Onsite transportation improvements are proposed to facilitate site access, circulation, and parking and includes access drives, circulating lanes, parking lots, and service area/fire access routes. Accessible pedestrian routes will also be provided between all major site features, public sidewalks, and the main school building. The parking lots and access ways on school property are designed with 24-foot wide aisles per City of Bozeman code. Curb, gutter, and asphalt will be used to construct the parking lots and access ways. Landscaped median islands constructed of curb and gutter are not proposed within parking lots on school property which is a departure from Zoning Ordinance but is allowed by the local inter-governmental agreement. Proposed terminal islands will instead be delineated by paint. This is typical of school construction in the area and discussions with local law enforcement indicated increased visibility resulting in less landscaped islands is a benefit for this type of use. In accordance with the current UDC a detailed analysis in the appendix outlines the request for an alternate method of calculating the number of parking spaces required. Additional information regarding parking lots, access drives, and public street infrastructure can be found in the project’s civil design report. Utilities City owned utilities are available in the area. The proposed water system associated with the new high school includes three major components. Oak Street Water Main According to the City of Bozeman Water Master Plan, a 16-inch water main is schedule for the Oak Street Corridor. The 16-inch main on Oak will be constructed as part of this project and will connect into the existing water system at the intersection of Flanders Mill Road and Oak Street (existing 16-inch stub installed with Flanders Mill Subdivision) and at the intersection of Cottonwood Road and Oak Street. A portion of the existing 12-inch water mains in the area of Cottonwood Road and Oak Street will be replaced with 16-inch mains to allow for unrestricted continuity north of Oak Street. The Water Master Plan indicates a future 16-inch water main extending north in the Cottonwood Road corridor. The 16-inch water main as part of this project will be extended north of the proposed roundabout to allow for extension in the future. A 2-inch service will be stubbed north of Oak Street to accommodate the future bathrooms associated with the sports park. This location has been coordinated with the Sports Park Master Plan and the size confirmed with the Sports Park engineering consultant. Annie Street Water Main An 8-inch water main loop will be constructed in the Annie Street corridor from Cottonwood Road to Flanders Mill Road. This line will serve to maintain the water system grid in the area and provide water service to the stadium complex comfort station and temporary irrigation needs. A 4-inch service will be extended to the comfort station riser room. 219 New Bozeman High School High School Water Main Loop Given the large size of the high school building and the land it is on, a water main loop in the vicinity of the new school is necessary to accommodate domestic and fire services along with allowing for fire hydrants in the vicinity of school. The high school water main loop will connect to the existing water system at the intersection of Cottonwood Road and the school’s northwest access drive. From there the main will extend east around the school, then loop north connecting back into the water system on Oak Street. A 30-foot utility easement will be provided for the water main loop. Water service to the school will be extend from the High School Waster Main Loop near the north end of the building. Plumbing calculations require a 4-inch domestic water service and a 6-inch fire service. The proposed sewer system associated with the new high school includes three major components. High School Sewer Services Four separate sewer services will exit the school building and discharge to the City of Bozeman Sewer System. The school program and support activities include kitchens and auto garage uses. All kitchen/cooking wastewater will be routed through an external concrete grease interceptor prior to discharging to the City of Bozeman sewer system. Similarly, wastewater flow from all interior auto garage areas will be routed through a sand/oil separator prior to discharging from the building. High School Sewer Main Due to the large area the School encompasses, multiple services are required as noted above. These services will manifold together in a private 8-inch sewer main located northwest of the school. Because this main serves only one building and is not located in public right-of-way, a private sewer main is proposed for the project. The Montana Department of Environmental Quality has confirmed the District can own and maintain the sewer main. The private main extends to the existing 21-inch sewer main located in the Cottonwood Road corridor. Comfort Station Sewer Services One 4-inch sewer service will be constructed to accommodate wastewater flow from the comfort station. The service discharges to the 21-inch main in the Cottonwood Road corridor. Storm drainage infrastructure is proposed to mitigate post development runoff conditions in accordance with City of Bozeman design standards. Storm drainage systems will consist of inlets and piping along constructed roadways, overflows, inlets, and integrated retention areas for onsite parking lots, roof drains, conveyance trunk-lines, and regional detention and retention ponds. An underdrain is currently proposed for the track complex and will be tied into the storm drain system. 220 New Bozeman High School Outfalls are proposed in the Maynard Overflow Ditch that runs adjacent to Flanders Mill Road and in a tributary to Baxter Creek located approximately ¼ mile west of the site. Additional information regarding site utilities can be found in the project’s civil design report. Additional Permitting Wetland and/or stream impact permits are required at three locations: 1. The storm drain outfall to an unnamed tributary of Baxter Creek: · Section 404 Permit (U.S. Army Corp. of Engineers); · 401 Certification (Montana Department of Environmental Quality [MTDEQ]) · SPA 124 (Montana Fish, Wildlife and Parks [MTFWP]); and, · 318 Authorization (obtained through MTDEQ or may be waived by MTFWP during the SPA 124 process). 2. The storm drain outfall to the Maynard Overflow Ditch: · Section 404 Permit; and, · 401 Certification. 3. The culvert crossing of Maynard Overflow Ditch located under the northeast access drive: · Section 404 Permit; and, · 401 Certification. Wetland areas have been delineated by Lynn Bacon, Professional Wetland Scientist with TerraQuatic, LLC. Stream and ditch ordinary highwater mark has been surveyed by TD&H Engineering. Wetland and stream impact applications are being completed by TerraQuatic and TD&H. The applications will be finalized after the City of Bozeman approves final project design and permits will be obtained prior to any wetland, stream, or ditch disturbance. MTDEQ construction storm water permitting (SWPPP) is also required for the project as a result of project disturbance over one acre. Initial SWPPP requirements and SWPPP details are shown on sheets C210 and C211. The project SWPPP will be submitted to MTDEQ and the City of Bozeman for approval prior to construction. LANDSCAPE NARRATIVE Site Organization The site layout is organized through the placement of major site elements. The school building is oriented toward Oak Street which provides ample buffer from Meadowlark Elementary. This placement also places the building in proximity to the future City Sports Park. The main school entry faces south to take advantage of the solar aspect and to provide a view to the expansive central green. This central green pushes parking areas to the exterior to provide open landscape views from the school. The open space will enhance the scholastic experience and link users to the outdoors through the creation of a more parklike atmosphere. Berms are used to further enhance this atmosphere and are utilized at the central green and along most exterior roadways to 221 New Bozeman High School help screen interior spaces. Pedestrian circulation allows the public to access the site from all exterior roadways and neighborhoods, funneling them toward the main school entry plazas. A planned public bus stop along Oak Street will have nearly direct access to the north entry. The main entry plazas will include enhanced landscaping, seating, overhead architectural canopies, bike racks, and hardscape areas. There will be a total of 70 bike parking stalls available throughout the site. Landscaping Site landscaping includes areas of standard bluegrass, shrub beds, native grass areas, and tree plantings. The bluegrass areas are located directly around the perimeter of the school building, in street areas between sidewalks and roadways, at the central green area directly south of the school, and in all areas designated for recreation. Recreation areas include practice fields, softball fields, areas associated with track field events, and the playfield in the interior of the track. Shrub beds are concentrated at the main entry plaza areas and in select areas near parking lots. The native grass areas are found around the perimeter the site and within storm water detention areas. They will greatly reduce water consumption, fertilization, and maintenance. These native grass areas will also help the school blend into a natural habitat of the valley floor. Storm water swales and detention ponds will receive a specialty seed mix appropriate for wet/dry areas and will be fully vegetated other than small direct inlet/outlet areas which will have cobble for erosion control. Most bluegrass and all native grass areas are planned for seeding. Only small areas near the school main entries will receive sod. Seeding will be accomplished by drill seeding methods with multiple runs required to achieve desired density. Areas will be reevaluated after initial germination and reseeded as necessary. All seeded areas will be planted on 6” of topsoil that will include amendments as required by a soil study. Areas within the median of Oak Street and Cottonwood Road and other disturbed areas not designated as bluegrass will receive native grass seed. West of Meadowlark Elementary and south of the New High School development area exists an undeveloped parcel of approximately 8.5 acres. This parcel is not considered a part of the New High School and thus will be handled as a separate school district project. This area is planned to receive native grass seed as a cover crop. Bluegrass areas (approximately 16.5 acres) will be mowed on a regular basis to maintain growth at approximately 2”. For the first two years, native grass areas within the school site will be mowed 4x per summer to assist in growth density and to help keep weeds from going to seed. Afterward, the native grass areas will be mowed a minimum of 2 to 3 times per growing season. Trees and shrubs are used for street enhancement, space creation, shading, screening, and general beautification. Trees will be planted along all dedicated roadways and clustered for a more natural look. Due to the clustering and use of asphalt pathways (potential root lifting), street trees have been pushed outside of the street boulevard at the required intervals (for Cottonwood Road, Flander’s Mill Road, and Oak Street only) by the City landscape requirements. Interior trees help create space on site by defining the edge around the central green and enframing the entry plazas. Shrub beds will receive 12” of topsoil – amended as needed. The soil in these areas will be topped with 3” of organic wood mulch. Due to safety concerns trees are not installed in parking areas so as to not obstruct cameras mounted on the light fixtures. 222 New Bozeman High School Weeds will be managed during construction by the contractor via herbicide and mowing, as described earlier. After the construction and required maintenance period by the contractor, the control of weeds will be managed by the school district via similar methods. The site currently consists of agricultural land which has been largely kept free of weeds. The entire project area will be regraded and planted and maintained as described. Irrigation All bluegrass, trees, and shrub bed areas will receive permanent irrigation. The native grass areas will be established through appropriate timing of seed germination based upon the natural wet cycle (spring or fall plantings) and/or temporary irrigation as needed for proper establishment. Approximately 11 acres of the site will consist of this native grass which results in the reduction of up to 30% water required to irrigate the site. Trees, shrubs, and perennials will be irrigated via a drip irrigation system. More than 75% of these species are considered drought tolerant and thus further reduce water needs. Bluegrass areas will be watered via spray rotor heads. The irrigation system will include a smart controller, automatic control valves, and a weather station. Athletic Areas The site will consist of 3 practice fields, 2 softball fields, a competition multiple sport field, field events such as shot put, javelin, and discus, jumping events such as the high jump, pole vault, and long jump, a completion level track with 10 lanes, and 8 tennis courts. The competition area will include bleachers, scoreboards, storage facility, and potentially a comfort station. Two fixed scoreboards will be installed, one at the track and one at the softball field. Selections of the scoreboards have not been made at this time. This area will be linked to Meadowlark Elementary via an asphalt trail. Chain link Fencing in athletic areas include a 10’ fence around tennis courts, backstops at the softball fields (a 4’ perimeter fence around one of them), and a 4’ barrier fence around the outside of the track. The school is also considering a 6’ ht. perimeter fence around the recreation areas south of Annie Street. Athletic areas will not be lighted for nighttime use at this time. Screening/Buffering The school will include a service yard in the north east corner of the building. This service yard is offset from Oak Street by a minimum of 110’, Flander’s Mill Road by 280’, and from the intersection of Oak and Flander’s Mill by 330’. Wide berms, and trees, including evergreen trees, will be installed in the buffer areas. These elements, along with a perimeter fence and fencing around trash and mechanical areas, help to screen the yard from roadways and parking areas. At least one of these fences will be opaque (based upon the selection of alternates). Parking areas will be screened using berms and trees. The parking areas nearest to a city street are along Cottonwood Road. They are offset from the roadway by 60’ helping to further create a visual buffer. Berms are also used on the edges of the central green to help screen the larger parking lots from the interior lawn space. Landscape Deviations 223 New Bozeman High School See Deviations section below. WATER RIGHTS General The New Bozeman High School requires water for three distinct and separate systems: potable water for the use by occupants in the building, water for ground source heating system, and water for irrigation. Potable Water The potable water source for the building occupants will be provided by the City of Bozeman’s public water system. The water service for the building will connect to the new water main located within the Oak Street rite-of-way (directly north of the project site.) Where possible, plumbing fixtures will be low-flow type. Ground Source – The new high school will utilize an open loop water source for the Variable Refrigerant Flow (VRF) mechanical system. Water will be extracted from three wells and reinjected into the aquafer using three injection wells. All wells will be located within the project site. This system is a non-consumptive use. This system will require a DNRC permit. To date a pre-application meeting has taken place and the development of the application is in process. We currently anticipate a permit for this use in early 2019. The City of Bozeman has agreed to allow the project to be permitted and constructed without a DNRC permit in place. This DNRC permit will be required before the City of Bozeman will issue an occupancy permit. In the event a permit is not obtained, the mechanical systems will be redesigned and resubmitted to the City of Bozeman for permit review. Irrigation Water Use – The site for the New High School will contain irrigated and non-irrigated areas. The site will have areas seeded with native grasses requiring no irrigation beyond that need to establish the grasses. The School District intends to obtain water rights for the property; this task is currently in process. The City of Bozeman is allowing the project to proceed without water rights in hand. The submitted documents currently show all irrigation water being fed from the City of Bozeman municipal water system. If water rights are not obtained the School District will pay the City of Bozeman Cash in lieu of Water Rights. DEVIATIONS General The School District and the design team have made every effort to fulfill the requirements of the City of Bozeman Unified Development Code. However, items have been deviated from to ensure the safety of the students. Whenever possible the deviations meet the overall intent of the City’s 224 New Bozeman High School requirement. The Interlocal Agreement School District 7 – City of Bozeman Dated November 12, 2012 (copy provided in the Appendix) permits such deviations. Part I.1.d of the Interlocal Agreement School District 7 – City of Bozeman dated November 12, 2012 permits an exemption from site development standards including, but not limited to, landscaping, lighting, and parking. We have taken efforts to comply with these standards where possible; however, it has been determined by the Bozeman Police Department that certain conditions resulting from the standards would reduce the safety and security of the students using the facility. During the design process, the School District and the design team met with the Student Resource Officer (SRO), the Police Chief and other life safety officials. The intent of these meetings was to determine the best possible solutions that would provide a safe learning environment for the students. As a result we are requesting the following deviations: Number of Parking Spaces Required, Parking Lot Landscaping, Parking Lot Screening, Street Trees, Irrigation, and Landscape Performance Standards. The 5 exemptions that the school board is asking for are important requirements that are required under state law to provide for environmentally sound and aesthetically pleasing construction. Currently, we are a very quiet neighborhood that will be inherently changed with the construction of the high school. Without denying the exemptions requests that the school are asking for, including to provide the landscaping through the project and screening of the parking lot in between the school and the residents; not allowing on street parking by the users of the high school; exempting the planting of trees in the public right of way and to conform to irrigation standards, our neighborhood will experience a drastic negative effect to the homeowners’ detriment. Before the construction of the elementary school, there was a large Cottonwood grove of trees that have been destroyed and never replaced. Now, the school board is attempting to skip providing the landscaping that would help bring back some of the lost trees and greenery in that area. Please don’t allow this to happen. Additionally, our neighborhood should not be forced to handle the increased parking that will happen if the city approves the exemption to allow on-street parking for users of the high school. As per Montana law (MCA 76-2-402) the HS2 design and site plan have some elements that are contrary to local zoning regulations. MCA 76-2-402 Local zoning regulations -- application to agencies. Whenever an agency proposes to use public land contrary to local zoning regulations, a public hearing, as defined below, shall be held. (1) The local board of adjustments, as provided in this chapter, shall hold a hearing within 30 days of the date the agency gives notice to the board of its intent to develop land contrary to local zoning regulations. (2) The board shall have no power to deny the proposed use but shall act only to allow a public forum for comment on the proposed use. BSD7 Board of Trustees: At the February 12 public meeting, the BSD7 Board of Trustees received an update regarding the design of the HS2 Property. In addition, the Board discussed the zone exemptions that would be forwarded to the City of Bozeman. The BSD7 Administration recommended that the Board of Trustees approve the HS2 design update and the indicated zoning and parking exemptions. After discussion and public comment, the Board voted to approve HS2 design update as well as the list of zoning exemptions. Annie street runs through the middle of the property. The proposed high school sits at the left and Meadowlark School property to the right. 246 Bozeman School District, High School #2 City of Bozeman, Agency Exemption Hearing, May 7, 2018 Parking Sec. 38.25.040 of the City of Bozeman Uniform Development Code (COB/UDC) does not permit off-site parking. Rationale: The site plan / design calls for 615 parking stalls on-site. Our planning consultants have estimated that approximately 415 stalls would be needed for students, staff and visitors on a typical school day. Approximately 870 spaces would be needed during occasional large school events. The District would like to use on-street parking on Annie Street and the west side of Flanders Mill to augment the on-site parking for large events. We estimate that Annie and Flanders Mill can accommodate 258 parking spaces. Parking will not be permitted on Cottonwood nor Oak as these are arterials. Parking Lot Landscaping Sec. 38.26.050.C of the COB/UDC requires that parking lots with more than 15 spaces shall have a minimum of 20sf of landscape area within the parking lot for each off-street parking space in a lot. Rationale: The primary rationale for this exemption is maintaining clear lines of site to enhance school safety. The intent is to provide better visual access and a higher level of 247 Bozeman School District, High School #2 City of Bozeman, Agency Exemption Hearing, May 7, 2018 safety for the students within the parking lots. The District follows best practices to enhance student safety and security when designing our parking lots. This practice has been endorsed by the Bozeman Police Department. In addition, this type of design is considered best practice by national research regarding school safety. Crime Prevention Through Environmental Design (CPTED) is defined as a multi-disciplinary approach to deterring criminal behavior through environmental design. CPTED strategies rely upon the ability to influence offender decisions that precede criminal acts by affecting the built, social and administrative environment. CPTED tries to decrease the conditions perceived as unsafe and increase the conditions perceived as safe. The CPTED school program uses six basic strategies — natural surveillance, access management, territoriality, physical maintenance, order maintenance and activity support. Natural surveillance This is design and placement of physical features in such a way as to maximize visibility. These features include windows, walkways, assembly areas, corridors, stairways, doors and lighting. The objective is to provide an environment in which you can see and be seen, to eliminate hiding or hard-to-see places, and thereby increase the perception of a human presence. For instance, in choosing landscaping material, schools should make sure that the material provides benefit without blocking views. Parking Lot Screening Sec. 38.26.050.C.2.a.(1) of the COB/UDC requires parking lot screening when adjacent to residential areas with 4’-6’ high fence or shrub. Rationale: The parking lots at the new High School will be more than 50’ from the public way and screened with 3’ high berms and tree groupings. The height of the berms on the site are restricted to 3’ due to security concerns. As stated in the previous rationale, maintaining lines of site are a recommended practice from national experts who have studied school safety. The CPTED, Natural Surveillance strategy encourages placement of physical features in such a way as to maximize visibility. Trees provided in public right-of-way Sec. 38.26.050.E.3​ ​of the COB/UDC requires street trees be provided in the public right-of-way. Rationale: The proposed trees have been placed outside of the public right-of-way to allow the tree roots to grow without damaging to the asphalt paths. In total, the landscape plan calls for more than 200 trees. The landscape plan calls for those trees to be located where it makes the most sense for the functionality of the school, while enhancing the views of adjacent property owners. In addition, trees placed in the public 248 Bozeman School District, High School #2 City of Bozeman, Agency Exemption Hearing, May 7, 2018 right-of-way along Annie street would be a safety concern for walking students, who will be crossing that road frequently to access the south portion of the campus. Irrigation Standards Sec. 38.26.050.I of the COB/UDC requires that all landscaped areas be provided with permanent irrigation. Rationale: Approximately 70% of the available site will be permanently irrigated lawn and athletic playing field. The site will include several areas (approximately 30%) of non-irrigated native grass. This design is to reduce water consumption. Seeding will be timed to take advantage of nature’s wet cycle. All other areas will receive permanent irrigation. Early in the planning and design process, the Board of Trustees asked that we consider following sustainable building design standards for the construction and ongoing operations of the school. To this end, the District is seeking to obtain Collaborative for High Performance Schools (CHPS) Certification. This program is similar to LEED Certification (US Green Building Council), however the CHPS certification is specific to school buildings. The CHPS National Core Criteria (Core Criteria) address indoor environmental quality, energy and water efficiency, site and materials selection, strategies for integration and innovation, and operations and metrics. The CHPS Core Criteria was developed to achieve three priority outcomes, in order of importance: ●Maximize the health and performance of students and staff. ●Conserve energy, water, and other resources in order to save precious operating dollars. ●Minimize material waste, pollution, and environmental degradation created by a school. The CHPS National Technical Committee has weighted the available point totals for prerequisites and mandatory offerings in seven categories to reflect these three priorities. The use of native grasses, which won’t require permanent irrigation, will help the District meet the outcome of water conservation, which is part of the CHPS priorities. In addition, water conservation can help reduce overall operational costs. Landscape Points Sec. 38.26.060 of the COB/UDC outlines Landscape Performance Standards. 249 Bozeman School District, High School #2 City of Bozeman, Agency Exemption Hearing, May 7, 2018 Rationale: The following points are anticipated to be earned: a.
