THIS INDENTURE ,Made and entered into this 3rd
day of
October, 1969, by the CITY OF BOZEMAN acting by and through the
City Commission of the City of Bozeman, Montana,
WIT N E SSE T H
'I'hat the City of Bozeman does hereby dedicate and designate
to the public the hereinafter described easement and right of way
for underground utilities over and across city park land in the
New Hyalite View Subdivision to serve Lots 1 to 11 of Block 1 and
Lots 1 through 5 of Block 19, all of New Hyalite View Subdivision,
to-wit:
A twenty foot wide easement for utility purposes only,
situated in that portion of the City Park area lying
north of and adjacent to Blocks 1 and 19 of the New
Hyalite View SUbdivision and more particularly described
as follows, to-wit:
Beginning at the Northwest corner of Lot one (1) of
Block One (1) New Hyalite View Subdivision; thence
easterly along the northerly line of said Block One (1)
and said line extended easterly a distance of 1138.8
feet to a point on the northerly line of Block Nineteen
(19) of said New Hyalite View Subdivision; thence north-
easterly along the northwesterly line of said Block Nine-
teen (19) a distance of 217.99 feet to a point on the
northerly line of said New Hyalite View Subdivision;
thence westerly along said northerly line of said sub-
division a distance of 41.1 feet; thence Southwesterly
parallel to and 20 feet distant northwesterly of the
northwest line of said Block 19 a distance of 171.0 feet
to a point; thence westerly parallel to and 20 feet
distant from the northerly line of said Block 1 and said
line extended easterly a distance of 1138.8 feet to the
easterly right of way line of New Hyalite View Road;
thence southerly along said easterly right of way line to
the true point of beginning. '
in accordance with that certain plat and map thereof marked Exhibit
"A" and hereto attached and by this reference incorporated herein.

a Notary Public for the State of Montana, personally appeared
R. Harry Morrow and Erna V. Harding known to me to be the Mayor
and the Clerk of the City Commission of the City of Bozeman,
Montana, and the persons whose names are subscribed to the within
instrument and acknowledged to me that they executed the same on
behalf of the City of Bozeman, Montana
IN WITNESS WHEREOF, I have hereunto set my hand and affixed
my Notarial Seal the day and year first above written.
