RIGHT-OF-WAY EASEMENT The CITY OF BOZEMAN, a municipal corporation, a political subdivision, of the State of Montana, in consideration of $1.00, and other good and valuable consideration, in hand paid, the receipt of which is hereby acknowledged, grants, conveys, and warrants to THE MONTANA POWER COMPANY, a corpo- ration, whose post office address is Butte, MT 59701, and to its ~;ucce:::~sors, assiCjlH;, and permittee:::;, t.hc rjght Lo construct, maintain, operate and remove an electric trans- mission line and other appurtenances over, along, and across that certain real property, located in Gallatin County, Mon- tana and particularly described as follows, to-wit: TOWNSHI P 1 SQ!:I'I'B._,-__RANGE 5 EA_!3T, P. M. ~. Section 26: S~SW~NE~, SE~NW~, NE~SW~NW~ and Svv~4NVJ\iNVg4 Described as follows: Beginning at a point on the West boundary line of Certificate of Survey No. 1015, (The Montana Power Company Piverside Substation Site) from which point the southwest corner of said site bears S.01oll'35"W., 55 feet, more or less; thence, from said point of beginngin, S.80008'29''W., 500 feet; thence, to a point on the North-South mid-section line of said Sec. 26; thence, N.870S4' 12"W., 289.9 feet to a pdint 2 feet northerly of the northerly right-at-way boundary of the Burlington Northern Railroad Company; thence, running parallel to said northerly boundary, N.55013'26"W., 2598 feet; thence, N.S6042'32"W., 77 feet, more or less, to the point of intersection with the said northerly right-ot-way boundary and the terminus point of said easement. As being depicted on the attached Montana Power Company Drwg. #41,994-C9. TOGETHER with the right of access to said right-of-way over and along existing roads and trails and the right to clear and remove all timber and brush from the right-of-way fifteen (IS') feet either side of said transmission line and to cut and remove such trees outside of ~;uch right-of-way which may endanger said line. THE GRANTOR does hereby covenant with the Grantee that is lawfully seized and possessed of the real estate above-described, that it may have a good and lawful right to convey it, or any part thereof, and that the Grantor will forever warrant and defend the title thereto against the lawful claims of all persons whatsoever.
