PUBLIC UTILITY AND ACCESS EASEMENT
THE HUMAN RESOURCE DEVELOPMENT COUNCIL, the GRANTOR, in consideration of
$1,00 and for other good and valuable consideration, receipt of which is acknowledged, grants to the
City of Bozeman, a municipal corporation of the State of Montana, with offices at 411 East Main,
Bozeman, Montana 59771-0640, GRANTEE, its successors and assigns, a perpetual utility and access
easement for the use of the public, in, through, and across an irregular strip of land situated in Gallatin
County, Montana, to be located on the following described real property:
A portion of Block "A", original townsite of Bozeman, located in the northwest one-quartet of
Section 7, Township 2 South, Range 6 East, P,M.M., City of Bozeman, Gallatin County,
Montana.
The easement is more particularly described on the attached Exhibits "A" and "B" which by this
reference are made a part hereof.
The GRANTOR states that they possess the real property described above and that they have a
lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights
and privileges herein granted without any interruption by the GRANTOR,
Thc GRANTOR and GRANTEE further agrec that this grant of eascmcnt is subjcct to the
terms, conditions, and restrictions set forth in the Quitclaim Dccd dated June 10, 1998 and the Consent
Instrument dated September 26, 2000, both recorded among the Land Records for Gallatin County,
Montana.
The terms, covenants, and provisions of this easement shall extend to and be binding upon the
heirs, e c
tors, personal rcpresentatives, successors, and assigns of the parties hereto,

EXHIBIT "A"
A 20-foot utility easement located in a portion of Block "A", original townsite of Bozeman,
located in the northwest one-quarter of Section 7, Township 2 South, Range 6 East, P,M,M., City
of Bozeman, Gallatin County, Montana, shown on Exhibit B and being more particularly
described as follows:
Commencing at the northeast corner oflot eighteen of said Block "A", thence south along the
line between lots seventeen and eighteen of said Block "A", a distance of 158.70 feet to the north
right-of-way of West Babcock Street;
Thence west along said north right-of-way of West Babcock Street, a distance of 149,92 feet to
the east right-of-way of South Tracy A venue;
Thence north along said east right-of-way of South Tracy Avenue, a distmlce of 107.60 feet to the
True Point of BegilU1ing of a 20.00- foot wide water main easement.
The water main easement of which the centerline is more particularly described as follows:
Thence at the True Point of Beginning, traveling in an easterly direction perpendicular to the east
right-of-way line of South Tracy Avenue for a distance of 79,00 feet.
The sidelines of said easement being lengthened or shortened so as to begin on the east right-of-
way line of said South Tracy A venue.
Said easement contains 1580 square feet, more or less and is subject to all easements of record.
