THIS INDENTURE, Made and entered into this Jllt~l day of
January, 1970, by the CITY OF BOZEMAN acting by and through the
City Commission of the City of Bozeman, Montana,
WIT N E SSE T H
That the Ci. ty of Bozeman does hereby dedicate and designate
to the public the hereinafter described easement and right of way
for underground utilities over and across city park land in the
New Hyalite View Subdivision, to-wit:
Beginning at the Southwest corner of Lot 1, Block 5,
New Hyalite View Subdivision of the City of Bozeman,
Montana; thence East a distance of seven hundred fifty
feet (750'), on and along the southerly property lines
of Lots 1 to 10, to the Southwest corner of Lot 10,
Block 5 of said subdivision; thence on and along a curve
to the left, said curve having a radius of two hundred
sixty feet (260'), an arc distance of two hundred four
and twenty hundredths (204.20 feet to the southeasterly
lot corner of Lot 11, Block 5 of said subdivision; thence
northwesterly on and along the northeasterly property
line of Lot 11, Block 5 of said subdivision a distance of
one hundred feet (100') to the northeasterly lot corner
of said Lot 11; thence northeasterly on and along a
curve to the left, said curve having a radius of one
hundred sixty feet (160'), an arc distance of 125.66
feet to the southwest corner of Lot 14, Block 3 of said
subdivision; thence east, a distance of one hundred feet
(100') to the southeast corner of Lot 14, Block 3 of
said subdivision; thence northwesterly on a curve to the
left, said curve having a radius of two hundred sixty
feet (260'), an arc dlstance of 306.30 feet to the
northwest corner of Lot 12, Block 3 of said sUbdivision,
said point lying on the easterly property line of Lot
11, Block 3 of said subdivision; said line being common
to Lots 11 and 12, Block 3 of said subdivision; thence
northeasterly on and along the easterly property line of
Lot 11 of said Block a distance of 21.45 feet to the
northeasterly property corner of Lot 11 of said Block,
said corner lying upon the southerly property line of
Lot 12, Block 2 of said subdivision; thence east on and
along the southerly property lines of a portion of Lot
12 and 13, Block 2 of said sUbdivision a distance of
113.56 feet to the point of curvature of a curve to the
right; thence m and along the curve to the right, said curve
having a radius of one hundred seventy feet (170'), a
distance of 194.33 feet to the southeasterly lot corner
of Lot 16, Block 2 of said subdivision; thence northeasterly
along the easterly property line of Lot 16 of said Block
a distance of one hundred feet (100') to the northeasterly
property corner of Lot 16 of said Block; thence southeasterly

a distance of twenty feet (20'); thence twenty feet (20')
distance from and parallel to the above described
description to the point of beginning.
Also, beginning at the northwest corner of Lot 1, Block
6 of sald subdivision; thence east a distance of seven
hundred fifty feet (750'), on and along the northerly
property lines of Lots 1 to 10 of Block 6 to the north-
west lot corner of Lot 10 of said Block, said point being
the point of curvature d a curve to the right; thence
on the curve to the right, having a radius of two hundred
eighty feet (280'), an arc distance of 879.66 feet to
the southwest lot corner of Lot 11, said point being
common to Lots 10 and 11 of Block 8 of said subdivision;
thence west on and along the southerly property lines of
Lot 1 through 10 of said Block, a distance of seven
hundred fifty feet (750') to the southwest lot corner
of Lot 1, Block 8 of said subdivision; thence south a
distance of twenty feet (20'); thence twenty feet (20')
distance from and parallel to the above described
description to the point of beginning.
Also, beginning at the northwest corner of Lot 1, Block
9 of said subdivision; thence east on and along the
northerly property lines of Lots 1 to 9 of sald Block
a distance of six hundred feet (600') to the northwest
lot corner of Lot 9, said point being the point of curvature
of a curve to the right; thence on and along the curve
to the right, having a radius of two hundred eighty feet
(280'), ~n arc distance of 879.61 feet to the southeast
corner of Lot 8, Block 11, of said subdivision; thence
west on and along the southerly property lines of Lots
1 through 8 of ~aid Block a distance of six hundred feet
(600')' to the southwest lot corner of Lot 1 of said Block;
thence south a distance of twenty feet (20'); thence twenty
feet (20') distance from and parallel to the above
described description to the point of beginning.
Also, beginning at the northwest corner of Lot 1, Block
12 of s~id subdivision; thence east, on and along the
northerly property lines of Lots 1 through 9 and a portion
of Lot 10, a distance of seven hundred fifty feet (750')
to the point of curvature of a curve to the left, said
point being on the northerly property line of Lot 10 of said
Block; th~nce on and along the curve to the left a distance
of 211.94 feet to a point on the northwesterl~ property
line of Lot 14 of said Block; thence North 18 33' East on
and along the northwesterly property lines of a portion

curvature of a curve to the right;
Thence on the curve to the right, said curve having a
radius of four hundred thirty feet (430'), an arc distance
of 244.05 feet along the northwesterly lot lines of a
portion of Lot 21,' 22 and a portion of Lot 23 of said
Block to a point, said point being the point of curvature
of a curve to the left; thence on and along the curve to
the left, said curve having a radius of one hundred seventy
feet (170'), an arc distance of 266.97 feet to the point
of curvature of a curve to the right; said curve having
a radius of four hundred thirty feet" (430'), an arc .
distance of 24.57 feet to a point which is twenty feet

17 of said subdivision; thence southwesterly parallel
to and twenty feet (20') distant from the southerly
property line of said Block a distance of twenty feet
(20'); thence parallel to and twenty feet (20') distant
from the above described description to the point of
beginning.
Also, beginning at the southeasterly property corner
of Block 17, of said subdivision; thence southwesterly
along the southerly property line of said Block a distance
of three hundred five feet (305') more or less to a
point on that part of the easement along Lot 15, Block
8 and Lot 14, Block 6 of said subdivision, thence
southerly a distance of 22.50 feet more or less; thence
parallel to and twenty feet (20') distant from the above
described description to the point of beginning.
Also beginning at the southwest lot corner of Lot 11,
Block 13 of said subdivision, said point also being the
point of curvature of a cu~Ve to the left; thence on the
curve to the left, said curve having a radius of four
hundred fifty feet (450'), along the southerly lot lines
of Lots 11 through 16, BLock lj and a portion of Lot 36,
Block 15 of said subdivision, an arc distance of 561. 07
feet; thence North 18023' East along the easterly property

to the point of curvature of a curve to the right; thence
on the curve to the right, said curve having a radius of
