TEMPORARY 100 FOOT DIAMETER STREET EASEMENT
BOZEMAN INTERFAITH HOUSING-2 MINOR SUBDIVISION, LOT 3
CITY OF BOZEMAN, GALLATIN COUNTY, MONTANA
FIRST BAPTIST CHURCH (Owner), a Montana Corporation, GRANTOR, in consideration
of the receipt of One Dollar ($1.00) and for other valuable consideration, receipt of which is hereby
acknowledged, does hereby grant to the City of Bozeman, a municipal corporation of the State of
Montana, with offices at 411 East Main Street, P.O. Box 640, Bozeman, Montana 59771-0640,
GRANTEE, a temporary cul-de-sac easement for the use by the public in, through, and across a strip
of land situated in the City of Bozeman, to be located on the following described real property:
A portion of the SW 1/4, Section 11, T2S, R5E, r.M.M., City of Bozeman, Gallatin
County, Montana, known as Bozeman Interfaith I-Iousing-2 Minor Subdivision
according to the official plat thereofon file and of record in the office of the County
Clerk & Recorder of Gallatin County, Montana, as shown and more particularly
described on Exhibit "A", attached hereto.
The GRANTOR warrants that it is lawfully seized and possessed of the real property
described above, that it has a lawful right to convey the property, or any part of it, and that it will
forever defend the title to this property against the claims of all persons.
The GRANTOR further agrees that the GRANTEE may peacefully hold and cnjoy the rights
and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants and provisions of this easement and agreement shall extend to and be
binding upon the hcirs, executors, administrators, personal representatives, successors ancl assigns
of the parties hereto.

Range 5 East, P.M.M., City of Bozeman. Gallatin County, Montana, being
mare particularly described as:
Commencing at the Northwest corner of Lot 1, Bozeman Interfaith
Housing 2, Minor Subdivision;
Thence North 89'24'00" East along the south right-of-way of West
Babcock Street, a distonce of 182.08 feet to the centerline of Pond Row;
Thence South 01'13'09" West along said centerline, a distance of
529.00 feet;
Thence South 88'46'51" East a distance of 30.00 feet to the eost
right-of-woy of Pond Row, being the true Point of Beginning;
Thence along a non-tangent curve to the right, a tangent in bearing of
South7T09'45" East, a rodius of 50.00 feet, a central angle of 170'35'49',
and an arc length of 148.87 feet to a point on a non-tangent curve
also being said east right-of-way of Pond Row;
Thence alon~ said curve to the left, having a tangent in bearing of
North 30'3101" East, 0 radius of 180.00 feet, centrol angle of 21'02'28",
ond an arc length of 66.10 feet;
Thence along said east right-of-way North 01"13'09" East, a distance of
