PUBLIC STREET AND UTILITY EASEMENT
Thomas R. Simkins and Rhonda J. Simkins, P. O. Box 939, Bozeman, Montana, Grantor, in
consideration of good and valuable consideration, receipt of which is acknowledged, grants to the
City of Bozeman, P.O. Box 640, Bozeman, Montana, a municipal corporation of the State of
Montana, Grantee, its successors, assigns, for public street utility purposes, in, through and across
the following described property situated in City of Bozeman, Gallatin County, Montana, more
particularlydescribed as follows and on the attached Exhibit "A":
A portion of the Lot 26 of Grar s Second Subdivision for the purpose of ingress,
egress and utilities in the Southeast 1/4 of Section 18, Township 2 South, Range 6
East, P,M.M., Gallatin County, Montana, being further described as f()lIows:
Beginning at the north comer of Lot 26, thence along a portion of the south right-of-
way line of O'Connell Drive as platted on Grafs Second Subdivision, South
6J035'24" West, a distance of 53.27 feet to the beginning of a tangent curve to the
left;
Thence along said curve to the left having a central angle of22053'48", an arc length
of 45.24 feet and a radius of 1 03.2 feet to a point on a non-tangent curve to the left
having a tangent bearing in of North 63028'53" West;
Thence along said curve to the left having a central angle of 100029'51", an arc
length of 97.35 feet and a radius of 55.50 feet, to a reverse curve to the right;
Thence along said curve to the right having a central angle of 72003'40", an arc
length of 13.21 feet and a radius of 10.50 feet to a point on the westerly right-or-way
of Lomas Drive;
Thence along said westerly right-of-way North 20051'00" West, a distance of3,65
feet to the Point of Beginning;
Said tract contains 1782 square feet, more or less.

The Grantor warrants that it is lawfully seized and possessed of the real property described above,
that it has lawful right to convey the property, or any part of it, and that it will forever defend the title
of the property against the claims of all persons. The Grantor further agrees that the Grantee may
peaceably hold and enjoy the rights and privileges herein granted without any interruption by the
Grantor.
The terms, covenants and provisions of the easement and agreement shall extend to and be binding
upon the heirs, executors, administrators personal representatives, successors, and assigns of the
parties hereto.
