PUBLIC ALLEY EASEMENT

Owenhouse Hardware Company of Bozeman, a corporation,
GRANTOR, for good and valuable consideration receipt of which is
hereby acknowledged, grants to the City of Bozeman, a municipal
corporation of the State of Montana, GRANTEE, for the public use,
a perpetual alley easement for the passage of vehicular and
pedestrian traffic, together with the customary uses attendant
thereto, including drainage and utilities, over, under, through,
and across a strip of land situated in Bozeman, Gallatin County,
Montana, and more particularly described as follows:
An easement for alley purposes across a portion of
Block 32 of Northern Pacific Addition to the City of
Bozeman, located in the northeast one-quarter of
Section 7, Township 2 South, Range 6 East, Principal
Meridian Montana, Gallatin County, Montana and being
further described as follows:
Beginning at the southeast corner of Lot 18, said Block
32, thence north 81-47-27 west along the south line of
said Lot 18, a distance of 4.04 feet. Thence north
00-06-20 west a distance of 130.23 feet. Thence along
a 20.00 foot radius curve to the left through a central
angle of 87-57-34 for an arc length of 30.70 feet.
Thence north 88-03-54 west a distance of 101.15 feet to
a point on the west line of said Block 32. Thence
along the west, north and east boundaries of Lots 18-22
of said Block 32 through the following courses;
North 00-04-53 west a distance of 3.99 feet.
South 88-03-54 east a distance of 124.45 feet.
South 00-06-20 east a distance of 153.97 feet to the
point of beginning.
Said easement being 1175 square feet (.0271 acres), and
as depicted in Exhibit A which is attached hereto and
incorporated herein by this reference.
The GRANTOR warrants that it is lawfully seized and
possessed of the real property described above, it has a lawful
right to convey the property, or any part of it, and that it will
forever defend the title to this property against the claims of
all persons.
The GRANTOR further agrees that the GRANTEE may peaceably
hold and enjoy the rights and privileges herein granted without
any interruption by the GRANTOR or its successors, assigns, heirs
or personal representatives.
The terms, covenants and provisions of this easement shall
extend to and be binding upon the heirs, executors, administrators,

personal representatives, successors, and assigns of the parties
hereto.

Phillip C. Adams and Louis R. Spain, proved to me on the oath of
the President, Phillip C. Adams, and Corporate Secretary, Louis
R. Spain of Owenhouse Hardware Company of Bozeman, a corporation,
that executed the foregoing Public Alley Easement and
acknowledged to me that they executed the same for and on behalf
of said corporation.
