PUBLIC STREET and UTILITY EASEMENT
Montana State University, GRANTOR, in consideration of $ 1.00 and for other good and
valuable considerations, receipt of which is acknowledged, grants to The Citv of Bozeman, a
municipal corporation of the State of Montana, with offices at 411 East Main, Bozeman,
Montana 59771-0640, GRANTEE, its successors and assigns, a perpetual street and utility
easement for the use of the public, in, through, and across a strip of land situated in Gallatin
County, Montana, forty-five (45) feet wide to be located on the following described real
property:
An unplatted tract located in the Southeast 1/4 of Section 13, Township 2 South,
Range 5 East, M.P.M.
The easement is more particularly described on the attached Exhibits "A" and "B",
which by this reference are made a part hereof.
The GRANTOR states that they possesses the real property described above and that they
have a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of
the parties hereto.

Public Street and Utility Easement Description
Beginning at the south 1/4 corner of Section 13, Township 2 South, Range 5 East, M.P.M.;
thence N 000 20' 25" W along the mid-section line of said Section 13 a distance of 1286.49 feet
to the northeast corner of Lot 2A, Boylans Addition Number 1 to the City of Bozeman, said
point also being on the south right-of-way line of Kagy Boulevard; thence N 890 08' 15" E
along the south right-of-way line of Kagy Boulevard a distance of 45.00 feet; thence S 000 20'
25" E a distance of 1286.49 feet more or less to a point on the north line of Tract IB of
Certificate of Survey 1393A; thence westerly along said north line of Tract 1B a distance of
45.00 feet to the south 1/4 corner of said Section 13, the point of beginning.
