Extensions may be sought under the provisions of Section 38.19.120.D. The master site plan shall have an initial entitlement period of five years. Perimeter Light Trespass Page 2 of 7 DRC Memo WinCo Foods Friday, March 2, 2018 4.0 Planning Advisory Comments 1.0 2.0 3.0 Engineering Division Griffin Nielson gnielsen@bozeman.net 406-582-2288 1.0 2.0 3.0 • The relocation of the onsite water and sewer mains will require the release and reconveyance of the existing easement and a new easement water and sewer easement to be executed and filed with the county clerk and recorder on the City’s standard easement form prior to site plan approval. • The western drive aisle at the rear of the building will require a mutual access easement to be filed from the access off Catron for Lot 8 of Gallatin Center Subdivision, Phase 1, to the proposed access on Cattail in order for delivery access to be guaranteed. • The applicant must provide a drainage easements for all drainage that crosses lots lines and all shared stormwater infrastructure prior to site plan approval. • The western drive aisle at the rear of the building must be two way in order for vehicle circulation to be provided for the site as a whole and more specifically the future phased parking area. Policy and the City of Bozeman Modifications to Montana Public Works Standard Specifications, and by this reference these standards are incorporated into and made a part of these regulations. The developer shall submit plans and specifications for the proposed facilities to the city and to the state department of environmental quality and shall obtain their approvals prior to commencing construction of any municipal water, sanitary sewer or storm sewer system facilities. Bozeman Municipal Code (BMC) Section 38.23.060.A states: Where determined to be necessary, public and/or private easements shall be provided for private and public utilities, drainage, vehicular or pedestrian access, etc. BMC Section 38.23.070.A.1 states: The developer shall install complete municipal water and sanitary sewer system facilities, or a system allowed by 38.21.030.D, and may be required by the city to install municipal storm sewer system facilities. These systems shall be installed in accordance with the requirements of the state department of environmental quality and the city, and shall conform with any applicable facilities plan. The city's requirements are contained in the Design Standards and Specifications Please clearly show fire riser room (note partially covering exit door). Please update all disciplines within set to coordinate loading dock configuration and design. Bozeman Municipal Code (BMC) Section 38.19.100.A.4.b states Design and arrangement of the elements of the plan (e.g., buildings, circulation, open space and landscaping, etc.) so that activities are integrated with the organizational scheme of the community, neighborhood, and other approved development and produce an efficient, functionally organized and cohesive development; Please show extent of the facade design wrapping from the front to both the north and south elevations, to ensure it will integrate with future abutting buildings. Please provide light poles pedestals details, for pedestals that are within 5 feet of paved area. Code Reference: Section 38.23.150. Site Lighting. Page 3 of 7 DRC Memo WinCo Foods Friday, March 2, 2018 4.0 5.0 6.0 • CIL water rights was deferred to the development stage, however, not estimate or check has been provided. • The street lighting sheets are not to scale, the plans must be corrected prior to site plan approval. • The street lighting will require a full plan and specification submittal and review as describe in the City of Bozeman Design Standards and Specifications Policy (DSSP). • The street lights must be incorporated into SILD prior to the issuance of an occupancy permit, per DSSP IV.J.1.a. • The geotech report states that the ground water elevation is approximately 6 to 8.5 feet below the existing grade, however these measurements were not taken during the season high. The applicant must provide verifications that all stormwater facilities will be located above the seasonal high ground water elevation. • The maintenance plan must be revised to include the maintenance details for the proposed dry well and infiltration system and incorporate the maintenance plan in the property owner’s association documents prior to site plan approval. • The applicant must demonstrate the site has been designed to infiltrate, evapotranspire or capture the first 0.5- inch of rainfall from a 24-hou storm preceded by 48-hours of not measurable precipitation, per the City of Bozeman Design Standards and Specifications Policy (DSSP) Section II.A.4. • The applicant must demonstrate that the proposed drywell has capacity to retain the 10 yr. 2 hr. storm and will infiltrate the stormwater prior to site plan approval. • The applicant must demonstrate that all stormwater conveyance structures have been design to accommodate the 25-year storm event prior to site plan approval. • If the site will utilized allocated capacity within the subdivision stormwater pond “Pond 4” the applicant must verify the volume and the outlet elevation. If the capacity of the pond has been reduced the applicant must expand the pond to support this project. • The applicant must provide a drainage easements for all drainage that crosses lots lines and all shared stormwater infrastructure prior to site plan approval. • The applicant must provide an estimate of the peak-hour sanitary sewer demand from the proposed project, which the City Engineering Division will use to evaluate downstream sanitary sewer capacity for the proposed project. Bozeman Municipal Code (BMC) Section 38.23.080.A states: The developer shall install complete drainage facilities in accordance with the requirements of the state department of environmental quality and the city, and shall conform to any applicable facilities plan and the terms of any approved site specific stormwater control plan. The city's requirements are contained in the design standards and specifications policy and the city modifications to state public works standard specifications, and by this reference these standards are incorporated into and made a part of these regulations. BMC 38.23.150.C states: Street lighting consists of street lighting and pathway intersection lighting, and shall comply with the City of Bozeman Design Standards and Specifications Policy (DSSP). BMC Section 38.23.180 states: the transfer of water rights or the payment of cash-in-lieu (CIL) of water rights shall be provided. Page 4 of 7 DRC Memo WinCo Foods Friday, March 2, 2018 7.0 8.0 9.0 10.0 • The applicant’s traffic impact study indicates severe deterioration of traffic conditions during the peak-hours at the intersection of Max Avenue and Cattail Street. The report indicates that the intersection currently operates at a Level of Service (LOS) of “B” for PM peak hour with future development decreasing the LOS to “E” for PM peak hour. The applicant must upgrade the intersection and show intersection upgrades on the drawings prior to site plan approval. • The access onto Cattail Street does not meet the City access separation requirements, as such the applicant will need to request a relaxation per BMC 38.24.090. H.3. In addition, the traffic impact study notes the drive access onto Cattail Street will only serve delivery operations, this access may not be restricted. BMC Section 38.41.080.A states Applications for all site plan approvals shall be submitted to the planning department on forms provided by the planning director. The site plan application shall be accompanied by the appropriate fee and development plans showing sufficient information for the approval authority to determine whether the proposed development will meet the development requirements of the city. BMC Section 40.03.960 A&B states: The operator of a restaurant or food preparation establishment discharging wastewater containing greater than 25 mg/l of oil and grease or that has a recurrence with grease building or blockage of sewer lines shall immediately install an approved grease trap. All sand and grease traps shall be properly maintained and serviced at the owner's expense. Records of maintenance and service for the sand and grease trap shall be made available to the city upon request by the engineer. BMC 38.24.010.A states: All streets shall be provided in accordance with the adopted growth policy and/or transportation plan. The arrangement, type, extent, width, grade and location of all streets shall be considered in their relation to existing and planned streets, to topographical conditions, to public convenience and safety, and to the proposed uses of the land to be served by such streets. BMC 38.24.100.B. States: Collector and local streets. On corner lots, on collector and local streets, in all districts, no fence, wall or planting in excess of 30 inches above the street centerline grades shall be permitted within a triangular area defined as follows: beginning at the intersection of the projected curblines of two intersecting streets, thence 40 feet along one curbline, thence diagonally to a point 40 feet from the point of beginning on the other curbline, then to the point of beginning. • A grease interceptor, conforming to the latest adopted edition of the Uniform Plumbing Code must be installed with any development responsible for food preparation. The grease interceptor must be shown on the site plan applications prior to approval. The applicant must contact the City Building Division (Bob Risk) to determine detailed requirements prior to building permit approval • The plans must contain details of how the electrical service will be routed to the internal site lighting. Page 5 of 7 DRC Memo WinCo Foods Friday, March 2, 2018 11.0 Engineering Advisory Comments 1.0 2.0 The applicant must contact the Gallatin County Conservation District, Montana Department of Environmental Quality, and U.S. Army Corps of Engineers regarding the proposed project and any required permits (i.e., 310, 404, Turbidity exemption, etc.) must be obtained by the applicant. The applicant must submit plans and specifications for water and sewer main extensions, streets, and storm water improvements, prepared and signed by a professional engineer (PE) registered in the State of Montana, which must be provided to and approved by the City Engineer. Water and sewer plans must also be approved by the Montana Department of Environmental Quality. The applicant must also provide professional engineering services for construction inspection, post-construction certification, and preparation of mylar record drawings. Construction shall not be initiated on the public infrastructure improvements until the plans and specifications have been approved and a preconstruction conference has been conducted. Building permits will not be issued prior to City acceptance of the site infrastructure improvements unless all provisions set forth in Section 38.39.030.C of the Bozeman Municipal Code are met to allow for concurrent construction. If not already filed the applicant shall provide and file with the County Clerk and Recorder's office executed Waivers of Right to Protest Creation of Special Improvement Districts (SID’s) for the following: a. Street improvements to Cattail Street including paving, curb/gutter, sidewalk, lighting, and storm drainage. b. Street improvements to Thomas Drive/N. 27th Avenue including paving, curb/gutter, sidewalk, lighting, and storm drainage. c. Street improvements to Max Avenue including paving, curb/gutter, sidewalk, lighting, and storm drainage. d. Intersection improvements to the intersection of Cattail Street and N. 27th Avenue. e. Intersection improvements to the intersection of Catron Street and N. 27th Avenue. f. Intersection improvements to the intersection of E. Valley Center Drive and N. 19th Avenue. g. Intersection improvements to the intersection of E. Valley Center Drive and Catron Street. h. Intersection improvements to the intersection of Cattail Street and N. 19th Avenue. i. Intersection improvements to the intersection of Max Avenue and Catron Street. j. Intersection improvements to the intersection of Max Avenue and Cattail Street. The document filed shall specify that in the event an SID is not utilized for the completion of these improvements, the developer agrees to participate in an alternate financing method for the completion of said improvements on a fair share, proportionate basis as determined by square footage of property, taxable valuation of the property, traffic contribution from the development, or a combination thereof. The applicant must provide this item prior to site plan approval. The applicant must prepare plans and specifications for any fire service line in accordance with the City’s Fire Service Line Policy. The plans must be prepared by a Professional Engineer and be provided to and approved by the City Engineer prior to initiation of construction of the fire service or fire protection system. The applicant must also provide Professional Engineering services for construction inspection, post-construction certification and preparation of mylar record drawings. Fire service plans, and domestic services 4” or larger, must be a standalone submittal, separate from the site plan submittal. City of Bozeman applications for service must be completed by the applicant. Future Impact Fees - Please note that future building permit applications will require payment of the required transportation, water, sewer and fire impact fees according to the City of Bozeman adopted impact fee schedule in place at the time of building permit issuance.
