HomeMy WebLinkAbout96- Mecklenburg, Lovfald Parking and Landscaping Easement, 1996 .. rlLM 168 PACfJO?7 PARKING AND LANDSCAPING EASEMENT THIS EASEMENT AGREEMENT, made this 10th day of May 1996, by and between the CITY OF BOZEMAN, a Montana municipal corporation, with principal offices located at 411 East Mainatr~ Bozeman, Montana, hereinafter referred to as "GRANTOR", and BRUCE MECKLENB!RC: HELEN D. LOVF ALD, LORIN O. LOVF ALD, AUDREY M. LOVF ALD, MICHAEL LOVF ALD, MARK LOVF ALD and MARCELLE LOYFALD, hereinafter referred to as "GRANTEES". WIT N E SSE T H: WHEREAS, thc Bozeman City Commission vacated a portion of West Babcock Street that was abandoned with the realignment and signalization of the West Babcock and West Main intersection; and, WHEREAS, the Grantees requested vacation of the remammg portion of the West Babcock Street right-of-way that due to the realignment and signalization of the West I3abcock and West Main intersection is not currently used as a street; and, WHEREAS, after consideration of the adjacent ownerships and the applicable vacation statutes, the Parties have agreed that it would be more expeditious and in the best interests of all thc parties involved for the Grantor to grant an casement to the Grantees for parking and landscaping improvements in lieu of vacation of the right-of-way, NOW, THEREFORE, the Grantor, for and in consideration of the facts above-recited and obligations herein contained and other valuable consideration, does hereby grant and convey unto the Grantee, and its assigns, a perpetual easement for parking and landscaping in and over and upon the following described property: A portion of West Babcock Street located in the East One-Half (EI2), Southeast One-Quarter (SE1f4) of Section 11, Township 2 South, Range 5 East, P.M.M., Gallatin County, Montana and morc particularly depicted on Exhibit "A", ffimexed hereto and incorporated by reference It is expressly understood and agreed that the use by the Grantees of the right-of-way shall be at all times subordinate to Grantor's use of the property, more specifically for existing and future utilities.
