IN CONSIDERATION OF THE PAYMENTS HEREIN SET FORTH AND THE SPECIFIC AGREEMENTS TO BE PERFORMED BY BOTH PARTIES HERETO AND WRITTEN IN THIS AGREEMENT, THE PARTIES HERETO BIND THEMSELVES TO THE TERMS AND CONDITIONS SET FORTH HEREIN. NO VERBAL AGREEMENTS SHALL BE BINDING UPON EITHER PARTY AND THIS AGREEMENT SHALL BECOME EFFECTIVE UPON EXECUTION BY A DESIGNATED REPRESENTATIVE OF THE CITY OF BOZEMAN. 2. COMPENSATION FOR LAND AND IMPROVEMENTS (List acres and/or sq. ft. and improvements in the taking.) Land: 2487 SF Commercial @ $6.50/SF 368 SF Drainage Easement @ $5.85/SF Improvements: None $16,165.50 $ 1 ,896.40 3. COMPENSATION FOR DAMAGES Move mail box Site restoration (tree, sod, plants, bushes) Temporary construction permit $ 350.00 $3,083.00 $ 994.50 $ 3,427.50 4. TOTAL COMPENSATION FOR PARCEL Rounded to $22,488.50 $22,500.00 5. IT IS UNDERSTOOD AND AGREED THE CITY SHALL MAKE THE FOLLOWING DISBURSEMENT OF PAYMENT NOT LATER THAN 30 DAYS FROM THE DATE WHEN THIS AGREEMENT IS EXECUTED BY EULA MAE LESSLEY. A warrant in the amount of $22,500.00 to be made payable to Eula Mae Lessley and mailed to Eula Mae Lessley at 2221 W. Babcock, Bozeman, MT 59715. (Continued on Next Page) . In addition to the payments set forth above, the City shall cause its contractors to: (a) Replace those portions of the existing pole fence along Babcock Street which are removed or damaged during the course of the construction project. The replacement shall be with new materials of the same or better kind and grade as that which now exists. The replaced portions shall be stained to the same shade of color as that which now exists. (b) Replace those portions of the existing board fence at the southeast corner of the Lessley property which is damaged or removed during the course of the construction project. The replacement shall be with new materials of the same kind and grade as that which now exists. The replaced portions shall be stained to the same shade of color as that which now exists. (c) Replace or repair the gate posts and the electrical wiring and fixtures attached to the posts to the same or better condition as that which now exists should the posts, wiring or fixtures be damaged or destroyed during the course of the construction project. (d) Replace or repair the underground irrigation system which services the Lessley property to the same or better condition as that which now exists should the system be damaged during the course of the construction project. (e) Replant or revegitate the grass sod in the temporary permit area to return that area to the condition that now exists. (f) Properly repair any damage to the driveway leading from Babcock Street to the Lessley home that occurs during the course of the construction project. (g) Properly repair any other damage of any kind or nature which occurs to any part or portion of the Lessley property, whether or not identified in this Agreement, that occurs as a direct re::;ult of the construction. 7. THE GRANTOR, hereby grants the City of Bozeman, a Temporary Construction Permit, of variable width, as shown on Exhibit A, attached hereto and made a part hereof, for the period of one year or the duration of the construction project, whichever is greater. 8. IT IS UNDERSTOOD AND AGREED THE Temporary Permit Area will be leveled and cleared of any debris after construction and left in a good, workmanlike condition.
