PUBLIC ROAD EASEMENT
Russ Kramer, a married man, of 9441 Big Gulch Road,
Bozeman, Montana 59715, GRANTOR, in consideration of Ten
Dollars ($10) and other good and valuable consideration,
receipt of which is acknowledged, grant to The Public,
GRANTEES, for the public use, a perpetual road easement for
the use of the public, in, through, and across a strip of
land situated in Gallatin County, Montana, more particularly
described as follows:
Beginning at a point, said point being the true
point of beginning on the boundary between Tract B
and Lot 32 B as described on Certificate of Survey
No. 35 K, said point also bears South 72008'12"
East a distance of 30.00 feet from the Southwest
corner of said Lot 32 B, thence North 88035'28"
East a distance of 89.48 feet, thence South
67058'52" East a distance of 146.70 feet, thence
North 83039'35" East a distance of 36.22 feet,
thence North 62012'34" East a distance of 167.30
feet, thence East a distance of 66.00 feet, thence
South 67039'04" East a distance of 47.99 feet to a
point on the boundary between Lot 32 A and Lot 32
B as described on Certificate of Survey No. 35 K
said point also bears South 03031'00" East a
distance of 270.00 feet from the Northeast corner
of said Lot 32 B, thence South 03031'00" East a
distance of 66.68 feet along said boundary between
Lot 32 A and Lot 32 B, thence North 67039'04" West
a distance of 65.23 feet, thence West a distance
of 39.31 feet, thence South 62012'34" West a
distance of 141.00 feet to a point on the boundary
between Tract B and Lot 32 B as described on
Certificate of Survey No. 35 K, thence North
72008'12" West a distance of 314.72 feet along
said boundary between Tract B and Lot 32 B to the
true point of beginning.
Certificate of Survey No. 35K is on file and of
record in the office of the Clerk and Recorder of
Gallatin County, Montana.
The GRANTOR agrees that he shall construct and maintain
the road in accordance with the specifications of the City
of Bozeman. Said maintenance shall continue unless or until
the road becomes a part of the street, road or highway
system of an appropriate governmental entity.
The GRANTOR warrants that he is lawfully seized and
possessed of the real property described above, that he has
a lawful right to convey the property, or any part of it,
and that he will forever defend the title to this property
against the claims of all persons.

The GRANTOR further agrees that the GRANTEES may
peaceably hold and enjoy the rights and privileges herein
granted without any interruption by the GRANTORS.
The terms, covenants and provisions of this easement
and agreement shall extend to and be binding upon the heirs,
executors, administrators, personal representatives,
successors, and assigns of the parties hereto.

Russ Kramer, known to me to be the individual who executed
the foregoing Public Road Easement and acknowledged to me
that he executed the same.
IN WITNESS WHEREOF, I have hereunto set my hand and
affixed my seal on the day and year first written above.
