Commission Memorandum
REPORT TO: Mayor and City Commission
FROM: Martin Matsen, Community Development Director
Addi Jadin, Associate Planner
SUBJECT: Ordinance 1998, Amending Bozeman Municipal Code Section 2.05.3000,
Design Review Board Duties
MEETING DATE: April 9, 2018
AGENDA ITEM TYPE: Action
RECOMMEND MOTION: Having reviewed the presented information, considered public comment,
and considered all of the information presented, I hereby move to approve Ordinance 1998, amending
Bozeman Municipal Code Section 2.05.3000, Design Review Board Duties.
EXECUTIVE SUMMARY:
Ordinance 1998 proposes to amend Section 2.05.3000 of the Bozeman Municipal Code to reflect
recently adopted amendments to the Unified Development Code (UDC) which included the revision of
Design Review Board (DRB) Plan Review thresholds and the removal of entryway corridors. Ordinance
1998 also proposes to remove Conditional Use Permit (CUP) review from the purview of the DRB.
PROPOSED AMENDMENTS:
With the removal of entryway corridor requirements from the UDC and the application of design
standards city-wide, the intent was for the DRB to review projects city-wide. The primary purpose of
the amendment proposed in Ordinance 1998 is to make that change.
Planning Staff also proposes to remove CUP review from the purview of the Design Review Board. The
DRB is established to evaluate aesthetic considerations of larger and more complex proposals rather
than the use of a property or building. As the City has moved toward administrative review of several
conditional uses with the special use permit, this amendment would further streamline review for
projects that are requesting a CUP but do not meet the DRB review thresholds of Section 38.230.040.C.
Finally, the amendment will correct code references in Section 2.05.3000 to reflect the new UDC
organization, will ensure that all references to DRB duties within the UDC are listed in Chapter 2, and
will remove redundant references.

Amendments proposed in Ordinance 1998 were reviewed by the Design Review Board on March 28,
2018 and were approved unanimously 4:0.
ALTERNATIVES: As directed by the Commission.
FISCAL EFFECTS: None are anticipated at this time.
