Farmers Canal Company, GRANTOR, in consideration of $ 1 <00 and for other and valuable
considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal
corporation of the State of Montana, with offices at 411 East Main, Bozeman, Montana 59715,
GRANTEE, its successors and assigns, a perpetual street and utility easement for the use of the
public, in, through, and upon two parcels ofland situated in Gallatin County, Montana, described
as follows:
Parcel A: Beginning at the South 1/4 corner of Section 11, Township 2 South, Range 5
East, P.M.M, City of Bozeman, Gallatin County, Montana; thence northerly along the
mid-section line of said Section 11 a distance of 30 feet to the true point of beginning;
thence northerly along said mid-section line a distance of 30 feet; thence easterly along a
line 60 feet northerly of and parallel to the south line of said Section 11 a distance of 80
rods (1,320 feet); thence southerly along the east line of the southwest 1/4 of the
southeast 1/4 of said Section 11 a distance of 5 feet; thence easterly along a line 55 feet
northerly of and parallel to the south line of said Section 11 a distance of 80 rods (1,320
feet); thence southerly along the east line of said Section 11 a distance of 25 feet; thence
westerly along a line 30 feet northerly of and parallel to the south line of said Section 11
a distance of 160 rods (2,640 feet) to a point on the mid-section line of said Section 11,
the true point of begilU1ing,
Parcel B: Beginning at the Southeast corner of Section 11, Township 2 South, Range 5
East, P.M.M., City of Bozeman, Gallatin County, Montana; thence northerly along the
east line of said Section 11 a distance of 55 feet to a point on the north line of Parcel A
described above, the true point of beginning; thence yvesterly along said north line cf
Parcel A a distance of 25 feet; thence northerly along a line 25 feet westerly and parallel
to the east line of said Section 11 a distance of 156 rods and 11 feet (2,585 feet); thence
easterly a distance of 25 feet to a point on the east line of said Section 11; thence
southerly along said east line of Section 11 a distance of 156 rods and 11 fcct (2,585 feet)
to the true point of beginning.
ALL AS shown on Exhibits A and B attached hereto and incorporated hcrcin by reference,
The GRANTOR states that they possess the real property described above and that they
have a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto,
