Public Street Easement PUBLIC STREET EASEMENT c. ::1 ~ 1~)3 ~i~CE 4p1 Delaney and Company, Inc., GRANTOR, in consideration of $1.00 and for other and valuable considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana, with offices at 411 East Main, Bozeman, Montana 59771-0640, GRANTEE, a perpetual street and utility easement for the use of the public, in, through, and across a strip of land situated in Gallatin County, Montana, which area is legally described as: LEGAL DESCRIPTION OF STREET AND UTILITY EASEMENT TO THE CITY OF BOZEMAN That part of Lots 7,8,9, 10 and 11, Block 1, Springbrook Addition to the City of Bozeman, according to the plat thereof, on file and of record in the office of the Clerk and Recorder, Gallatin County, Montana, described as follows: Beginning at the northwest corner of said Lot 11, thence easterly 090"04'02", assumed azimuth from north, 116.05 feet along the north line of said Lots 11, 10, 9, 8 and 7, thence southerly 1790 54'47" azimuth 15.27 feet along the westerly right of way line of North 7th Avenue; thence westerly 2850 12'00" azimuth 43.18 feet; thence westerly 270 04'02" azimuth 74.40 feet; thence northerly OOOU 03'03" azimuth 4.00 feet along the west line of said Lot 11 to the point of beginning, (See Exhibit" A" attached hereto) Said easement is located in the Northeast Quarter of Section 12, Township 2 South, Range 5 East of P,M.M. Area of Easement: 699 square feet or 0,016 acre. The GRANTOR states that they possess the real property described above and that they have a lawful right to grant an easement thereon. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR. The terms, covenants, and provisions of this easement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors, and assigns of the parties hereto.
