PUBLIC STREET AND UTILITY EASEMENT
(Babcock Street)
Michael W, Delaney and Ileana Indreland, of 101 East Main Street, Bozeman, MT 59715,
GRANTORS, in consideration of $1.00 and other valuable consideration, receipt of which is
hereby acknowledged, grants to the City of Bozeman, a municipal corporation of the State of
Montana, with offices at 411 East Main Street, P.O. Box 1230, Bozeman, Montana 59771-1230,
GRANTEE, its successors and assigns, a perpetual public street and utility casement fCll' the use
of the public, over, under, and across, a strip ofland 45.00 feet wide situated in Gallatin County,
Montana, and located on the following described property:
Tract 2, Certi1icate of Survey No. 1846, located in the SW 1/4 of Section 10, 'fownship 2
South, Range 5 East of r.M.M..
Said easement is the north 45.00 feet of said Tract 2, and is more particularly shown and
described on the attached "Easement Exhibit A", which by this reference is made a pm1 of this
document.
The GRANTORS state that they possess the real property described abovc and that they have a
lawful right to grant an casement thereon,
The GRANTORS further agree that the GRANTEE may peaccably hold and enjoy the rights and
privileges herein granted without any interruption by the CiRANTOR,
The terms, covenants, and provisions ofthis easement shall extcnd to and be binding upon the
heirs, executors, administrators, personal representatives, successors, and assigns of the parties
hereto,
