5 AU Guaranteed Maximum Price
Pursuant to Section 2.2.6 o f the Agreement, the Owner and Construction Manager hereby
amend the Agreement to establish a Guaranteed Maximum Price. As agreed by the Owner
and Construction Manager,the Guaranteed Maximum Price is an amount that the Contract
Swn shall not exceed. The Contract Sum consists of the Construction Manager's Fee plus
the Cost oft3he Work, as that tenn is defined in Article 6 ofthis Agreement
S A.1.1.1 The Contract Sum (No. 6) is guaranteed by the Construction Manager not to exceed
one hundred twenty-nine thousand six hundred ten dollars and 95 cents,
($129,610.95), for realignment of Maynard irrigation pipeline for a total contract
sum of four million five hundred sixty-five thousand six hundred sixty-three and 00
cents($4,565,663.00) subject to additions and deductions by Change Order as provided in
theContract Documents.

As per section 5.2 and 5.3 of our Agreement for the Bozeman Sports Park Project, we are requesting an
amendment to increase our Guaranteed Maximum Price (GMP) for the Maynard Irrigation Pipeline
Realignment portion of the project. This request is based on design changes and owner additions which are
detailed on attached exhibits. This amendment is a request for an addition$31,489.82 for a new GMP of
$335,250.89. This request includes using$12,600 of the contingency budget established In amendment#1.
Please note that applying a portion of the available contingency is outside its intended use in this case, (see
section 2.2.4) but this portion of the project nearly complete. There remains$10,000 in contingency for
potential future items. Please reference the attached exhibit for additional clarifications and cost
breakdown for the additional items.
The date of Substantial Completion of April 17, 2017 does not change with this amendment.

Dear Carolyn,
As per our agreement for the Bozeman Sports Park Project,we are requesting Amendment#6 to i
incorporate the Maynard Pipeline water user requirements into the project. This amendment is in the
amount of$129,610.95. The amended GMP total would be$4,565,663,00. Please reference exhibit"A"for I
a breakdown on how we derived our proposed amendment.
The contingency for this amendment is estimated at$6,000 which is estimated at approximately 4.85%of
the construction cost for the above referenced scopes of work. Contingency will be utilized per the AIA
Document A133-2009 agreement between the owner and Construction Manager.
We have negotiated the cost of the change order with Maynard Pipeline Realignment contractor, H and H
Earthworks. Their pricing is reasonable and in line with similar work.
We have the following clarifications as per section 2.2.3 of our contract:
1. We acknowledge the attached list of drawings(exhibit B).
2. Our clarifications and assumptions in regards to our GMP as follows.
a. This GMP is only for incorporating the Maynard Pipeline Realignment Water User
Requirements as shown on the attached drawings,
b. Additional phases and scope will cause amending our agreement at a later date. i
c. DAC has not included any allowances in our GMP#6.
d. Testing services shall be contracted separately by the owner.
e. As per section 3.7.1 of the contract the owner shall secure and pay for the building permits
and fees as well as for other permits, fees, licenses, and inspections by government agencies {
necessary for proper execution and completion of the work that are customarily secured
after execution of the contract and legally required at the time bids are received or
negotiations concluded.

f. The general condition cost in our spreadsheet is zero as this work will be completed in
conjunction with previously accepted work. Additional general condition costs will be added
as scope from other trades are added to our contract.
3. Our proposed GMP as per exhibit A is$129,610.95. Please reference the spreadsheet exhibit A for
a breakdown of the bid package cost, contingency and construction manager fee. Scope of work
contained in the bid package for Maynard Pipeline Realignment Water User Requirements can be
found on the attached drawings.
4. The anticipated date of substantial completion is April 20, 2018
5. Our GMP#6 must be accepted and approved by March 141", 2018 for the above to become valid.

TEMPORARY CONSTRUCTION EASEMENT
THE GRANTORS, Bozeman Public Schools, whose address is 404 West Main Street, Bozeman MT
59715, for and in consideration of One and No/100 - Dollars, and other valuable consideration, in hand
paid, conveys and warrants to the GRANTEE, City of Bozeman, a municipal corporation of the State of
Montana, whose office address is 121 N. Rouse, Bozeman, MT 59715, its successors and assignees, an
unrestricted Temporary Construction Easement, over, and across the following described real property
located in Gallatin County, Montana:
LEGAL DESCRIPTION
Commencing at the southeast corner of Tract 1A1 of COS 255413, from a 2%"found aluminum cap at the
1/161h corner marking the intersecting rights-of-way for Flanders Mill Road and Oak Street in Section 4,
Township 2S, Range 5E, N89°50'12"W 53.71 feet,to the true point of beginning(POB) of easement:
Thence S 1°41'39"E 233.86 feet,thence N 50' 55'22"W 372.10 feet,thence S89°50' 14"E, 281.95 feet
to the point of beginning, and containing 0.756 acres, more or less as shown on Exhibit A.
delineated as to said tract of land on the exhibit attached hereto and made a part hereof as Exhibit A of
this instrument. Said parcel, containing approximately one acre (4315 square feet), more or less, is
hereby provided to the Grantee, for the purpose of constructing an irrigation pipeline (re-routed) as
indicated in Exhibit A, as necessary for the Bozeman Sports Park Project.
Upon completion of said project for which access is hereby provided, the Grantee shall restore the property
as nearly as possible to its original condition, including removal of the abandoned pipe. The Grantee agrees
to hold Grantors harmless from any and all liability that may result or arise from the exercise of the rights
granted hereby.
The Grantors hereby covenant with the Grantee that the Grantors have good title to the above-described
tract of land, and covenant that the Grantee shall have quiet and peaceable possession thereof and use
thereof during the period of the Temporary Construction Easement. This Temporary Easement is in
effect for six months form the date of execution, at which time this easement shall expire and be of no
force and effect.
