PUBLIC STREET and UTILITY EASEMENT
Philip S. Cook and Salie B. O'Malley, GRANTORS, in consideration
of $1.00 and other good and valuable consideration, the receipt
of which is hereby acknowledged, grant unto The City of Bozeman,
a municipal corporation of the State of Montana, with offices at
411 East Main Street, Bozeman, Montana, 59715, GRANTEE, its
successors and assigns, a perpetual street and utility easement
for the use of the public, in, through, over and across a strip
of land situated in Gallatin County, Montana, 45 feet wide to be
located on the following described real property:
Tracts 3 and 4 of Van Horn Subdivision, located in the SW1/4 of
Section 11, T2S, R5E, P.M.M" Gallatin County, Montana.
The easement is more particularly described on the attached
Exhibit(s) A and B, which by this reference are made a part
hereof.
The GRANTORS state that they possess the real property
described above and that they have a lawful right to grant an
easement thereon.
The GRANTORS further agrees that the GRANTEE may peaceably
hold and enjoy the rights and privileges herein granted without
interruption by the GRANTOR,
The terms, covenants, and provisions of this easement shall
extend to and be binding upon the heirs, executors,
administrators, personal representatives, successors, and assigns
of the parties hereto.
