BOZEMAN BUILDING CODE BOARD OF APPEALS APPLICATION FOR APPEAL
CITY OF BOZEMAN BUILDING CODE BOARD OF APPEALS
The Board of Appeals was established by commission resolution to determine the suitability of alternative materials and methods of construction and to provide reasonable interpretation of the
provisions of the following codes of the City of Bozeman: Building Code, Electrical Code, Mechanical Code, and the Plumbing Code. The Board cannot waive code requirements, i.e., cannot grant variances from the codes. The Board meets as needed to conduct business and hear appeals. The board hears appeals
not more than ten (10) days after filing thereof, and renders decisions and findings in writing to
the appellant with a copy to the Building Official. The board consists of five (5) members appointed by the City Commission (serving without compensation) who are qualified by experience and training to pass upon matters pertaining to
building construction. The City Building Official is an ex-offico, non-voting member of the board
and acts as Secretary of the Board. The City Commission assigns a commissioner/liaison to the Board. Current board members and commission liaison can be viewed at

Once an appeal has been filed, the Building Official works to find a meeting date that works for the board members, within the prescribed timeframe. All meetings of the board are public open meetings, subject to appropriate public notice.
Appeals are conducted as public hearings which include a staff report to the board, a presentation by the appellant, board questions of the appellant and staff, any public comment relevant to the appeal, final summation by the appellant, board discussion and board action.
