1. IN CONSIDERATION OF THE PAYMENTS HEREIN SET FORTH AND THE SPECIFIC

7. IT IS UNDERSTOOD AND AGREED THE Temporary Permit Area will be leveled
and cleared of any debris after construction and left in a good.
workmanlike condition.
8. IT IS UNDERSTOOD AND AGREED THE landscaping. trees and shrubs located
within the construction permit area on Parcel 6. right of Sta. 19+23
to Sta. 25+25. will be left in place.
9. IT IS UNDERSTOOD AND AGREED THAT compensation for all landscaping,
including the sprinkler system. light standard and other site
improvements. are included herein and any replacement will be the
sole responsibility of the Grantors.

12.THE CITY OF BOZEMAN HEREBY GRANTS, a right turn, ingress only. access

stations ~3150 and 24+00. sUbject to the following provisions: 1) No
~~ egress from this property shall be allowed through this access;
~", '2) the approach design. appropriate signing. appurtenant interior
parking lot modifications, and all other related construction for
the approach shall be the Grantor's responsibility; and.
3) construction of the approach and related improvements shall not be
initiated until the final plans for the approach and related
construction have been approved by the City.

10.IT IS UNDERSTOOD AND AGREED THAT the City of Bozeman will transfer to
the Grantor. title to that portion of West Babcock Street, shown as
Parcel 6A on attached Exhibit A. It is further understood,and
agreed that transfer of Parcel 6A. will not be completed until the
proposed reconstruction of the West Main Street/23rd Avenue
intersection is complete. Also. the asphalt surface of Parcel 6A
shall be removed and disposed of by the City of Bozeman or it's
contractors. In the event. the City of Bozeman cannot convey
title of P~rcel 6A to the Grantor by Mar~h 1. 1996. the dollar
amount of the Total Compensation for Parcels under Item No.4 above.
shall be renegotiated. No other provisions of this Agreement shall
be renegotiated unless mutually agreed to by the Grantor and Grantee.
In the event that the parties are unable to renegotiate the dollar
amount of compensation. the parties agree to submit the dollar amount
of compensation to non-binding arbitration. In the event the parties
cannot reach an agreement. either party shall have the right to have
the total amount .of the compensation determined by the court under
the eminent domain statute. Upon the final execution of this
agreement by both parties. the City of Bozeman will initiate and
diligently pursue the transfer of Parcel 6A pursuant to the State of
Montana street vacation statutes.
II.IT IS ALSO UNDERSTOOD AND AGREED THAT. as part of this agreement and
the compensation provided herein. the Grantors will remove the
sign (University Square/Albertsons) that is located approximately
85 feet right of Sta. 358+00 on West Main Street. from Parcel 4
before October 1. 1995. and furthermore. if the sign is relocated on
the Grantor's remaining property, it's relocation will be in
compliance with City ordinances.
