EIGHT OF ~AY EASEMENT
THIS INDENTURE, made this Jl<'.1fort day of Novt)mber, 1994, pursuant to the following
and;
IN CONSIDERATION OF THE SUM OF $10.00 (OVC) lawful money of the United states to
it in hand paid by the CITY OF BOZEMAN (herein "City"), th~J receipt of which. is
hereby acknowledged, witnesseth that,
CNL INCOHE FUND X, LTD., a Florida limited partnership (herein "Grantor")
400 East South Street, Suite 500
Orlando, Florida 32801
does hereby GRANT, BARGAIN, SELL and CONVEY unto the City, its agents and
assigns, an easement for right of Vlay to construct, operate and maintain drainage
facilities as may be required over, under and across the following described land
for the benefit and use of the City and its ENGINEERING DEPARTMENT, to-wit:
Easempnt Are~:
Parcel No. 2 on Hontana State Highway Project No. 94-306, West
Babcock, West Main Bnd 23rd Avenue, as shown on the Right of Way
Plan for said project on file in the office of the County Clerk &
Recorder in Gallatin County, Montana. Said parcel is also described
as a tract of land in the SE 1/4 of Section 11, Township 2 South,
Range 5 East P.M.M" Gallatin county, Montana, as shown by the
shaded area on the plat, consisting of 1. sheet, attached hereto as
Exhibit "A" and made a part hereof, which Easement Area contains 253
square feet, more less;
situate in the County of Gal,latin, State of Montana, TOGETHER HITB the right of
ingress and egress over and across the lands of the Grantor to and from the
Ea8ement~' Area, the right to clear and keep cleared all trees and other
obstructions from the Easement Area as may be necessary, and the right to pHrmit
the City's agents and contractors to use the right of way jointly with the City
for the purposes Bet forth herein.
Any construction, operation and maintenance of the drainage facilities in the
Easement Area shall be conducted 80 as not to damage the Grantor's adjacent,lands
and the improvements thereon. The City hereby agrees to promptly repair or
restore, at its sole cost and expense, any damage to Grantor's adjacent lands and
the improvements thereon caused by the City, its agents and contractors. All
entries by the City, its agents and contractors, onto the Easement Area and onto
the Grantor's adjacent lands shall be at the risk of City, and Grantor shall have
no liability for any injuries sustained by the City or any of City'S agents or
contractora, The City hereby agrees to indemnify and hold Grantor harmless from
any and all lOBS, claim, action, demand or liability which may arise against the
Grantor or the Grantor's lands by virtue of any of city's actions pursuant to
this Right of Way Easement. Upon completion of City' B conut;ruction and
maintenance of the drainage facilities in the Easement Area, the City shall
restore the Grantor's lands and the improvements thereon to the same condition
as existed before City's entry upon the Grantor's lands.
The Grantor reserves the right to occupy, use and cultivate the Easement Area for
all purposes not inconsistent with the rights herein granted to the City.
