PUBLIC STREET EASEMENT
BAXTER CREEK BUSINESS PARK - pun
J.e. BILLION, GRANTOR, in consideration of $1.00 and for other and valuable considerations,
receipt of which is acknowledged, grants to the City of Bozeman, a municipal corporation of the
State of Montana, with offices at 411 East Main, Bozeman, Montana 59771-0640, GRANTEE, its
successors and assigns, a perpetual street and utility casement for the use ofthe public, in, through,
and across a strip ofland situated in Gallatin County, Montana. The strip ofland being one hundred
fifty five and fifty two hundredths (155.52) feet by twenty five (25.00) feet wide, located on the
following described real property:
A tract of land located in the E 1/2, SE 1/4, SE 1/4, of Section 9 in Township Two (2)
South, Range Five (5) East, PMM, Gallatin County, MT.
The easement is more particularly described on the attached Exhibits "A" and "B", which
by this reference are made a part hereof.
I'he GRANTOR states that they possess the real property described above and that they have
a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights
and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors, and assigns of the parties
hereto.

Montana, and being described as follows:
25' WIDE PUBLIC STREET EASEMENT:
Being a portion of the E 1/2 SE 1/4 SE 1/4 of said section 9;
and being a 25' wide strip adjacent to and east of the
boundary between , BAXTER CREEK BUSINESS PARK-PUD, and
J.C. BilLION AUTO PLAZA SUBDIVISION.
Being more particularly described as follows:

25' WIDE PUBLIC STREET EASEMENT
A tract of land located in the E 1/2 SE 1/4 SE 1/4,
of Section 9, T2S, R5E, PMM City of Bozeman,
Montana, and being described as follows:
A 25' wide easement being 25' east of and parallel to the following
described line;
Commencing on the S 1/16 corner of sections 9 & 10
at a found M.D.O.H, Aluminum cap;
Thence along the North boundary of J.C. BilLION AUTO
PLAZA SUBDIVISION, S 88. 57' 30" W for a distance of
622.23 ' to the NW corner of said J.C.BllLlON property;
and the True Point of Beginning;
Thence continuing on the N-S property boundary between
J.C. BILLION AUTO PLAZA SUBDIVISION AND BAXTER CREEK
BUSINESS PARK-PUD , S 00. 31' 11" W for a
distance of 155.52' to the North Right-of-Way of
Competition Drive and the end of the easement.
The boundaries of said easement to begin and end on the
North Property Boundary of J,C. BILLION AUTO PLAZA SUB,
and the North R.O. W. of Competition Drive.
Said Easement being 0.09 acres, more or less.
