PUBLIC STREET AND UTILITY EASEMENT

James W. Bentley, of P.O. Box 10806, Bozeman, MT 59719, GRANTOR, in consideration of
receiving annexation to the City of Bozeman along with accompanying rights and privileges and for
other valuable consideration, receipt of which is hereby acknowledged, grants to the City of
Bozeman, a municipal corporation ofthe State of Montana, with offices at 411 East Main, P.O. Box
1230, Bozeman, Montana 59771-1230, GRANTEE, a perpetual street and utility casemcnt for the
use ofthe public, over, under, and across, a strip ofland situated in Gallatin County, Montana, 45.00
feet wide to be located on the following described real property:
The West Half of the East Half ofthe Southeast Quarter ofthe Southwest Quarter of Section 35,
Township 1 South, Range 5 East, of P.M.M., Gallatin County, Montana, EXCEPTING
THEREFROM a tract ofland in the Southwest Quarter of Section 35, Township 1 South, Range
5 East, ofP.M.M. Gallatin County, Montana, described as follows: Commencing at the south
onc-quarter corner of said Section 35; thence South 89016' 00" West on and along the south line
of said Section 35, a distance 01'330.52 feet to the true point of beginning; thence South 89016'
00" West on and along the south line of said Section 35, a distance of 165.26 feet; thence North
000 05' 30" West a distance of 527.17 feet; thence North 890 16' 00" East a distance of 165.26
feet; thence South 000 OS' 30" East a distancc of 527.17 feet to the true point of beginning. Deed
refcrence Doc. No. 2045415.
The easement is the south 45.00 feet ofthc above described property, and is more particularly shown
and described on the attached EASEMENT EXHIBIT which by this refcrencc is made a part hereof.
The GRANTOR states that he possesses the real property described above and that he has a lawful
right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may pcaceably hold and enjoy the rights and
privileges hercin granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding upon the heirs,
executors, administrators, personal representatives, successors, and assigns of the parties hereto.
