BACKSLOPE AND ROADWAY CONSTRUCTION
PERMIT
BOZEMAN DEACONESS FOUNDATION, a Montana corporation of
Bozeman, Montana 59715, GRANTOR, in consideration of Ten Dollars
($10.00) and other good and valuable consideration, receipt of
which is acknowledged, grants to the City of Bozeman, a municipal
corporation of the State of Montana, 411 East Main, Bozeman,
Montana 59771-0640, GRANTEE, its successors and assigns, a back-
slope and construction permit for the purpose of construction of
roadway improvements, ditches, and backslopes for lateral embankment
support for Highland Boulevard, in, through and across a strip of
land situated in Gallatin County, Montana, to be located on the
following described real property:
Parcels of ground in the SW 1/4, Section 8, NW 1/4, Section
17, and the SE 1/4, Section 18, Township 2 South, Range 6
East, P.M.M.
The particular permit descriptions are more particularly
described on the attached Exhibit, which by this reference is made
a part hereof.
This grant includes the right of the GRANTEE, its successors,
permittees, licensees and assigns and its and their agents and
employees, to enter at all times, until the final construction of
4 lanes is completed, upon the above-described land by using
existing roads or trails or otherwise by a route causing the least
damage and inconvenience to the GRANTOR in order to survey and
establish the route and location of the permit and to:
1. Construct the roadway improvements.
The GRANTEE agrees that:
1. In connection with the construction of said roadway
improvements, it will repair or replace, at its sole
expense, or pay to GRANTOR the reasonable value of any
damages to growing crops, existing fences, utilities,
ditches and other appurtenances of said land that may
be disturbed by its operation.
2. The areas disturbed by construction shall be topsoiled
to a depth of six inches (6") and seeded with grass
landscaped areas.

The GRANTOR agrees that:
1. They are lawfully seized and possessed of the real
property described above, that they have a lawful
right to convey the permit.
2. The GRANTEE may peaceably hold and enjoy the rights
and privileges herein granted until the final construc-
tion of the roadway is completed (4 lanes total) or
until January 1, year 2000, whichever comes first.
The terms, covenants and provisions of this permit and
agreement shall extend to and be binding upon the heirs, executors,
administrators, personal representatives, successors and assigns
of the parties hereto.

The property which is subject to this instrument is located
in the City of Bozeman, Montana, and is particularly described
as follows:
1. A 35 foot wide strip of land, lying west of, parallel with
and contiguous with the west right-of-way line of Highland
Boulevard between station 26+45.56 and station 32+25.07.
2. A 20 foot wide strip of land lying west of, parallel with
and contiguous with the west right-of-way line of Highland
Boulevard between station 32+25.07 and station 49+65.07.
3. A 200 foot wide strip of land lying west of, parallel with
and contiguous with the west right-of-way line of Highland
Boulevard between station 49+65.07 and station 51+35.18,
inclusive of the Hillcrest entrance/exit.
4. A 35 foot wide strip of land lying west of, parallel with
and contiguous with the west right-of-way line of Highland
Boulevard between station 51+35.18 and station 59+98.66.
5. A 25 foot wide strip of land lying south of, parallel with
and contiguous with the north right-of-way line of Ellis
Street between station 1+00 and station 3+00.
6. A 50 foot wide strip of land lying east of, parallel with
and contiguous with the east right-of-way line of Highland
Boulevard between station 26+70.56 and station 32+25.07.
7. A 25 foot wide strip of land lying east of, parallel with
and contiguous with the east right-of-way line of Highland
Boulevard between station 32+25.07 and station 38+61.95.
8. A 20 foot wide strip of land lying east of, parallel with
and contiguous with the east right-of-way line of Highland
Boulevard between station 38+61.95 and station 45+62.36.
9. A 35 foot wide strip of land lying east of, parallel with
and contiguous with the east right-of-way line of Highland
Boulevard between station 45+62.36 and station 51+35.18.
10. A 25 foot wide strip of land lying east of, parallel with
and contiguous with the east right-of-way line of Highland
Boulevard between station 51+35.18 and station 59+96.66.
Note: All centerline stationing is referenced to the construction
drawings for the improvements to Highland Boulevard,
ID No. 647.
