PUBLIC STREET AND UTILITIES EASEMENT

Ralph K. Aaker of Boulder, CO., and Steven R. Aaker, of Louisvillc, Co., GRANTORS, in
consideration of $1.00 and other valuable consideration, rcceipt of which is hercby
acknowledged, do hereby grant to the City of Bozeman, a municipal corporation of the State of
Montana, with offices at 411 East Main, P.O. Box 640, Bozeman, Montana 59771-0640,
GRANTEE, one (1) perpetual street and utility easement for the use of the public, over, under,
and across, one (1) strip of land situated in Gallatin County, Montana, being a part of Lot 2,
Minor Subdivision No. 191, according to the plat thereof, on file and of record in the office of
Clcrk and Recorder, Gallatin County, Montana, and located in the Southeast Quarter of Section
14, Township 2 South, Range 5 East, of P.M.M., and more particularly shown and described on
the accompanying Easement Exhibit, which is made a part of this document by this reference.

described above, and that they have and that they will forever defend the title to this property
against the claims of all persons.
The GRANTORS further agree that the GRANTEE may peaceably hold and enjoy the rights
and privileges herein granted without any interruption by the GRANTORS.
The terms, covenants, and provisions of this easement shall extend to and be binding upon the
heirs, executors, administrators, personal representatives, successors, and assigns of the parties
hereto.
