PUBLIC STREET EASEMENT
19th & Main. LLC, GRANTOR, in consideration of $1.00 and for other and valuable considerations,
receipt of which is acknowledged, grants to the City of Bozeman, a municipal corporation of the State of
Montana, with offices at 411 East Main, Bozeman, Montana, 59715, GRANTEE. its successors and
assigns, a perpetual street and utility easement for the use of the public, in through, and across a strip of
land situated in Gallatin County, Montana, 30 feet wide to be located on the following described real
property: Across a portion of Lot 1 of Kirk's Subdivision NO.3 (plat F-38) and Lot 2A of the Amended Plat
of Kirk's Subdivision No.3. Lot 2 (plat F-38A) alona the south boundary line.
The easement is more particularly described on the attached Exhibit, which by this reference is made a
part hereof.
The GRANTOR states that he possesses the real property described above and that he has a
lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and
privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding upon the
heirs, executors, administrators, personal representatives, successors, and assigns of the parties hereto.

LEGAL DESCRIPTION - PUBLIC STREET AND UTILITY EASEMENT
A Public Street and Utility Easement being a portion of Lat 1 of Kirk's Subdivision
No. 3 and Lot 2A of The Amended Plat of Kirk's Subdivision No.3, Lot 2 located
in the Northwest One-Quarter of Section 12, Township 2 South, Range 5 East,
Principal Meridian Montana, City of Bozeman, Gallatin County, Montana and being
further described as follows.
Beginning at a point bearing South 89'07'14" East a distance of 11.59 feet from
the West One-Quarter Corner of said Section 12 said point being the Southwest
Corner of said Lot 2A.
Thence along the west line of said Lot 2A through the following courses;
North 01'22'44" East a distance of 9.43 feet;
Along a 1367,64 foot radius curve to the right through a central angle of
00"51'43" for on ore length of 20.57 feet, with a chord bearing of North
01"48'35" East a distance of 20.57 feet;
Thence South 89"07'14" East 0 distance of 364.05 feet to a point on the east
line of said Lot 1;
Thence South 02"40'45" West along said east line 0 distance of 30.01 feet to the
Southeast Corner of said Lot 1 said point being on the south line of the
Northwest One-Quarter of said Section 12;
Thence North 89"07'14" West along the south line of said Lots 1 and 2A and the
south line of said Northwest One-Quarter a distance of 363,52 feet to the point
of beginning.
Said easement being 0.25 acres, along with and subject to any existing
