D. ~, Between LAYTON S. THOMPSON and MARGARET E. THOMPSON, husband and wife, of Bozeman, Gallatin county, Montana, parties of the first part, and the CITY OF BOZEMAN, a municipal corpora- tion of the State of Montana, in Gallatin County, party of the second part: WITNESSETH: That the said parties of the first part, for and in consideration of the sum of One Dollar and other valuable consideration ($1.00 ovc), to them in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, haVEtgranted, bargaineci, sold and conveyed , ap,dby these_ pre..aents. do- grant, bargain, sell and convey, unto the said party of the second part, and to its successors and assigns, a perpetual ease- ment and right-of-way for the purpose of constructing, installing, maintaining and removing a storm sewer pipeline over and across the following described real property situate in the City of Bozeman, county of Gallatin, State of Montana, to-wit: The southerly ten feet (101) of that certain tract of land recorded in Book 90 of Deeds at page 613, records of the County Clerk and Recorder of Gallatin County, Montana, said easement beginning at a point on the East line of south Tracy Avenue at Cleveland Street and extending in an easterly direction along the south line of the above mentioned tract, a distance of 180 feet together with the right of ingress and egress to and from the 4 above described real property at all reasonable times for the purpose of installing, operating, using, repairing, replacing, maintaining and removing said storm sewer pipeline and the appurtenances thereto: The consideration for this conveyance is less than $100.00 and as such requires no revenue stamps. TO HAVE AND TO HOLD the above described easement with all the appurtenances and privileges unto the said party of the second part, and to its successors and assigns, so long as the easement hereinbefore described is used as an easement for a storm sewer pipeline: provided, that if at any time the use of the storm sewer pipeline is discontinued by the party of the second part, the easement herein granted shall terminate.
