This Easement Agreement, made this l!L day of ~,uJ t- ,199 to ,
by and between IIJ!erm()/iI1;!--rmt t1 V ~c-. , hereinafter called "Grantor" and the City
of Bozeman, a municipal corporation, hereafter called "City".
RECITALS
WHEREAS, the Grantor is the Owner of:
1324 East Main Street, Bozeman, Montana 59715
and situated on the following described real property:
Rearrangement of Elks Club Property, Amended Tract 5B-2.
WHEREAS, the City proposes to construct concrete sidewalk on the above described
property as shown on Exhibit "A" (included herewith).
WHEREAS, the City retains a right-of-way which extends from the curb to the
Grantor's property line;
WHEREAS, the City's right-of~way is not wide enough to accommodate the desired
intersection sidewalk configuration;
AND WHEREAS, the sidewalk is to be constructed by the City as part of the
proposed East Main Street/Highland Boulevard Intersection and Traffic Signal Improvements
Project.
NOW, THEREFORE, the Grantor, for and in consideration of the facts above recited
and of the obligations herein contained, does hereby grant and convey unto the City and its
assigns an irrevocable and perpetual easement described in Exhibit "A" in, to, over and upon
the sidewalk and the land appurtenant thereto for pedestrian ingress and egress and the
Grantor and City agree as follows:
1. The easement herein created includes the right to use the sidewalk and such land
appurtenant thereto which is necessary or convenient for the exercise of this easement.
2. The City agrees to construct the sidewalk at their expense.
3. This Easement shall run with the land and be fully transferable and assignable in
connection with the sale or other transfer of 1324 East Main Street as an appurtenance thereto
and shall be binding upon the heirs, successors and assigns of the Grantor and the City.

CONDUIT EASEMENT DESCRIPTION
A tract of land situated in Tract 58-2, Elks Club Property Subdivision, Gallatin County, Montana.
Said tract being more particularly described as follows, to wit:
Beginning at a point on the south right-of-way line of East Main Street, said point of beginning
being the northwest corner of Tract 58-2, ELKS CLUB PROPERTY SUBDIVISION; thence
S. 74034'11" E. a distance of 15.54 feet, thence S. 65025'11" W. a distance of 23.79 feet,
thence N. 250 22'39" E. a distance of 15.53 feet to the point of beginning, said tract
contains 118.86 square feet.
