PEDESTRIAN ACCESS EASEMENT
Marvin and Judv Cowdrey, GRANTORS, in consideration of $ 1.00 and for other and valuable
considerations, receipt of which is acknowledged, grants to The Citv of Bozeman, a municipal
corporation of the State of Montana, with offices at 411 East Main, Bozeman, Montana 59715,
GRANTEE, its successors and assigns, a pedestrian access easement for the usc of the public, in,
through, and across a strip ofland situated in Gallatin County, Montana, seven (7) feet wide to be
located on the following described real property:
Lot I, Block 1, University Square Subdivision, City of Bozeman, Gallatin County,
Montana.
The easement is more particularly described on the attached Exhibits A and B
which by this reference are made a part hereof.
The GRANTORS do hereby grant and convey unto the City and its assigns an irrevocable and
perpetual easement in, to, over and upon the sidewalk and the land appurtenant thereto for pedestrian
ingress and egress and the Grantor and City agree as follows:
1 . The easement herein created includes the right to use the sidewalk and such land appurtenant
thereto which is necessary or convenient for the exercise of this easement.
2. The Grantors agree to maintain the sidewalk at their own cxpense in accordance with thc
relevant City Ordinances, including, but not limited to, snow rcmoval and all major and
minor rcpair work.
3. The Grantors further agree to allow the City to make any and all inspections of the sidewalk
and land appurtenant thereto as the City rcasonably deems necessary.
4. This easement shall run with the land and be fully transferable and assignable in connection
with the sale or other transfer of Lot 1, Block 1, Univcrsity Square Subdivision as an
appurtenance thereto and shaIl be binding upon the heirs, successors and assigns of the
Grantors and the City.
The GRANTORS state that they possess the real property dcscribed above and that they
have a lawful right to grant an easement thereon.
The GRANTORS further agree that the GRANTEE may peaceably hold and enjoy the rights
and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this casement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors, and assigns ofthe parties
hereto.

PEDESTRIAN ACCESS EASEMENT DESCRIPTION
A seven (7) foot wide pedestrian access easement across Lot I, Block I Univcrsity Square
Subdi vision, City of Bozeman, Montana, the centerline of which is the centerline of the existing
5-foot wide sidewalk located on said Lot I. The centerline is more particularly described as
follows:
Centerl inc "A": Beginning at the southeast corner of said Lot I, Block 1, said corner
being also the intersection of the north right-of-way line of Dickerson Street and the west right-
of-way line of S. 20th Avenue, thence N 890 59' 45" W along said north line of Dickerson Street a
distance 01'92 feet more or less to the true point of beginning; thence N 54045' 44" E a distance
of 112.6 feet more or less to a point on said west linc of S. 20th Avenue, the end of the easement.
Centerline "B": Beginning at the southeast corner of said Lot 1, Block 1, said corner
being also the intersection of the north right-of-way line of Dickerson Street and the west right-
of-way line ofS. 20th Avenue, the true point of beginning; thence N 450 00' 18" W a distance of
53.9 feet more or less to a point on said Centerlinc "A", the end of the easement.
