That he is a citizen of the United States, of lawful age and
residing at Missoula, Mis80ula County, Montan~~
That he is aoquainted with the following described real prop-
erty situate in Gallatin County, Montana, now owned by Paul G. Smith
of Bozeman, Montana:
All that part of the Northwest Q.uarter of the Northeast
Q.uarter of Section Six (6), Township Two (2) South, of Range
Six (6) East of the Montana Principal Meridian, containing
eight (8) aores, more or less,exclusive of public roads and
highways, included wi thin the follow ing descr ibed metes and
bounds; Beginning at a point 859.7 feet South and 30 feet
East of the quarter section corner on the North line of
Section Six (6) and running thence North, parallel with and
30 feet East of the North and South quarter line in the
said section Six (6), 384.7 feet; thence East 70 feet;
thence North 200 feet; thence West 32 feet to a point on
the East boundary of the highway; thence along a right
curve with a radius of 818.8 feet for a distance of 270

shown on the attached plat, excepting rights-of-way hereto-
fore granted over and across said land.
That by Bond for Deed dated august 28, 1918, and recorded
June 28, 1920, in Book 62 of Deeds at page 66 of the records of the
office of the County Clerk and Recorder of Gallatin County, T. B.
Story and Katharine F. Story, husband and wife, of Bozeman, Montana,
firmly bound themselves unto Robert Yetsinga to deliver to said
Yetsinga a good and su!fio1entWtrranty Deed to the above described

. property and other lands if the said Yetsinga should on or before
the 1st day of November, A. D., 1933, have paid the obligators the
sum of ~14,363.00, whioh purohase price was secured by a promissory

note in that amount of even date with the said Bond for Deed;
That by a ~uitclaim Deed dated August 5, 1920, and recorded
November 19, 1920, in Book 62 of Deeds at page 329 of the records

of the offioe of the County Clerk and Reoorder of Gallatin County,
T. B. Story of Bozeman, Montana, conveyed to Nelson Story approxi-
mately the same property which was the subject of the aforementioned
Bond for Deed, whioh ~uitclaim Deed set forth in the body thereof
that the property conveyed therein was subject to the terms and pro-
visions of the aforementioned Bond for Deed and that the title to
said property was to vest in the said Robert Yetsinga, or his
assigns, upon the payment by him of the purchase price specified in
said Bond for Deed;
That by ~uitclaim Deed dated March 18, 1921, and recorded
February 23, 1922, in Book 64 of Deeds at page 309 of the records
of the office of the County Clerk and Recorder of Gallatin County,
Nelson Story and Ellen T. Story, husband and wife, of Bozeman,
Montana, oonveyed to Elera Koch, Trustee, approximately the same
property which was the sUbjeot of the aforementioned Bond for Deed
and the aforementioned Quitclaim Deed from T. B. Story to Nelson
Story, which Quitclaim Deed set forth in the body thereof that the

of the aforementioned Bond for Deed and that the title to said
property was to vest in the said Robert Yetsinga, or his assigns,

That in the year 1919 Laurentza M. Koch, mother of your
affiant, was the owner of 500 shares of the story Work Sheep Co.,
a Montana corporation, now defunct, which stock was personally
guaranteed by the said T. B. Story;
That in the year 1919, Laurentza M. Koch, as Trustor, and
E1era Ko^oh, .,.Trustee, entered iata a trust agreement, whi ch
agreement was executed by Laurentza M. Koch on or about the 17th
day of February, 1919, and by E1ers Kooh on or about the 21st day
of February, 1919, by the terms of which agreement the aforesaid
500 shares of the Story Work Sheep Co. were transferred to Elers
Koch in trust, the proceeds from which trust were to be divided

equally among the four children of Laurentza M. Kooh, viz. Stanley
Koch, Elers Koch, Lucie Koch and Martha Nelson, upon her death;
That in the year 1927 the aforementioned trust agreement was
extended for such a period as was necessary for the collection of
certain promissory notes constituting a part of the trust fund,
which notes were signed by Robert Yetsinga, T. B. Story, and others;
That when the Story Work Sheep Co. became insolvent on or
about the year 1921, T. B. Story assigned and transferred to Elars
Koch in satisfaction of his personal guarantee on tbe aforesaid 500
shares of the Story Work Sheep Co., various properties owned by him
or by him and his wife, latharine F. Story, including the aforesaid
promissory note from Robert Yetsinga the balance owing on which was
at that time $11,363.00;
That the aforement ioned Q,ui tclaim Deed from Nelson Story and
wife to Elers Koch, Trustee, sets forth in the body thereof that
the aforesaid note executed by Robert Yetsinga had been assigned
to Elars Kooh and that theconvayance was made on account of the

That by ~uitclaim Deed dated March 14, 1925, and recorded
April 23, 1925, in Book 68 of Deeds, page 185 of the records of
the office of the County Clerk and Recorder of Gallatin County,
Katharine F. Story transferred approximately the same property
which was the subject of the aforementioned Bond for Deed, the
aforementioned ~uitclaim Deed from T. B. Story to Nelson Story and
the aforementioned Quitclaim Deed from Nelson Story and Ellen T.
Story to ElaTs Koch, Trustee, which ~uitclaim Deed set forth in
the body thereof that the property conveyed therein was subject to
the terms and. prov1fifi'Ons of the aforementioned Bond for Deed and
that the title to said property waS to vest in the said Robert
Yetsinga, or his assigns, upon the payment by him of the purchase
price specified in said Bond for Deed, and which Q,uitclaim Deed,
as given by the Grantor to the Grantee, corrected the omission in
the afqrementioned ~uitclaim Deed from T. B. Story to Nelson Story
of Katharine F. storyts name as G.antor;

That as the said Robert Yetsinga made periodic payments upon
the aforesaid promissory note assigned by T. B. Story to E1ars Kooh,
Trustee, your affiant, as such Trustee, executed and delivered deeds
to the said Yetsinga transter1ng portions, of the real property
herein described to the said Yetsinga;
That the aforesaid promissory note was paid off in full by
Yetsinga i.n tb.e year 1927 and a Q.uitclaim Deed and the final trans-
fer was made by your affiant, as Trustee, and his wife, Gerda H.
Koch, by Q.uitclaim Deed dated August 24, 1927, and recorded Septem-
ber 20, 1927, in Book 71 of Deeds on page 164 of the records in the
office of the County Olerk and Recorder of Gallatin County;
That the prooeeds received by your affiant, as Trustee, from
the said Robert Yetsinga's payments on the aforesaid promissory
note assigned to the affiallt by T. B. Story were divided and dis-
tributed equally among the four children of Laurentza M. Koch, the
beneficiaries of such trust, in aocordance with the provisions of
the aforementioned trust agreement and the extension thereof;

no longer exists.

1 Creek, dating as far back as 1882; that in making his survey and
2 investigation for the purpose of oompiling said memoranda, the
3 water right of Nelson Story and W. H. Traoy in and to 225 inohes of
4 the waters of Bozeman Creek, appropriated in 1866, was evidenoed;
5 that this water right appropriation of 225 inohes was the subjeot
6 of an aotion to determine the title thereto as between the said
7 Nelson Story and William H. Traoy, Plaintiffs, vs. Aylesworth and
8 Edsall, Defendants; that the Deoree was made and given Ootober 6th,
9 1896, Book "6" of JUdgments, page 520, of reoord in the office of
10 the Clerk of the Distriot Court, Gallatin County; that said 225
11 inches passed by mesne oonveyances, duly made by Nelson Story and
12 W. H. Traoy, to various parties; that the 7 inohes appurtenant to
13 the foregoing desoribed land passed from Nelson Story to T. B.
14 Story, and from T. B. Story, by mesne oonveyanoes, to Paul G. Smith;
