FOR AND IN CONSIDERATION of the sum of Five Thousand
Dollars ($5,000.00) , the receipt whereof is hereby acknowledged,
from the CITY OF BOZEMAN, MONTANA, the undersigned do hereby
grant and extend to the City of Bozeman and its assigns, to and
until March 1, 1970, the first and exclusive right and option to
purchase the following described lands situate in Gallatin County,
Montana, to-wit:
The Southeast Quarter (SE~) and all that part
of the Southwest Quarter (SW~) lying East of the
County road in Section 30, Township 1 South, Range
6 East, M.P.M., containing approximately 200 acres,
more or less, according to the official plat thereof
on file and of record in the office of the Gallatin
County Clerk and Recorder;
Together with all tenements, hereditaments and
appurtenances'fuereunto belonging, but reserving unto
the undersigned the water rights and ditch rights
appurtenant to said premises, including but not
limited to that certain spring rising in the North-
east Quarter of the Southwest Quarter (NE~SW~ ) of
said Section 30, and a pipeline easement from said
spring to a dwelling house and outbuildings be1ong- .._~.
ing to the undersigned situate in the Southwest Quarter
of the Northeast Quarter of the Southwest Quarter
(SW~NE~SW~ ) of said Section 30, Township 1 South,
Range 6 East, M.P.M.
for the total purchase price of One Hundred Thousand Dollars
($100,000.00) upon the following terms:
1. The sum of Twenty Thousand Dollars ($20,000.00) on or
before March 1, 1970, of which amount the sum dFive Thousand
Dollars ($5,000.00) paid for the option shall be a credit, leaving
a balance of Fifteen Thousand Dollars ($15,000.00) to be paid
upon the exercise of the option to purchase; the balance of the
purchase price, to-wit,the sum of Eighty Thousand Dollars
($80,000.00) , together with interest at the rate of six percent
(6%) per annum to be paid in two hundred forty (240) equal monthly
installments commencing on January 10, 1971, and monthly thereafter

until the balance of the purchase price and interest is paid
in full.
2. Upon the exercise of the option and payment of Fifteen
Thousand Dollars ($15,000.00) , the undersigned consent to convey
title to said lands to the City of Bozeman, Montana, or its
assigns, in exchange for an installment promissory note for the
balance of the purchase price to be secured by a first mortgage
on said lands.
3. In further consideration of the option payment of Five
Thousand Dollars ($5,000.00) the undersigned hereby give and
grant to the City of Bozeman immediate possession of the South-
east Quarter of the Southeast Quarter (SE~SE~) of Section 30,
Township 1 South, Range 6 East, M.P.M. and access thereto for
refuse dump purposes.
4. Upon payment of the further sum of Seven Thousand Five
Hundred Dollars ($7,500.00) on or before March 1, 1970, the
undersigned agree to extend the terms of this option for an
additional six (6 ) months to and including the 1st day of
September, 1970, and said additional payment shall be a credit
against the balance due leaving a balance of Seven Thousand
Five Hundred Dollars ($7,500.00) to be paid upon the down pay-
ment of the purchase price.
5. The undersigned hereby agree to pay all real property
taxes for the year 1969 and a pro-rata share thereof for the
year 1970 depending upon the time of exercise of the option.
