WARRANTY DEED
THIS INDENTURE.. Made the 19th day of Septemb~, A. D.,
one thousand nine hundred and fifty-eight, between VIVIAN CANFIELD, an
unmarried woman of Bozeman, Montana, the party of the first part, and the
CITY OF BOZEMAN.. a municipal corporation, of Bozeman, Montana, the
party of the second part,
WITNESSE TH
That the party of the first part desires to plat lands owned by
her as "Cleveland Subdivision, a suburb to Bozeman, Montana", and that the
party of the second part has required that first party convey to the party of
the second part the hereinafter described lot as a condition to the City approv-
ing the plat of said subaivision in order that said lot can be held, used or
sold for City park purposes of the City of Bozeman.
NOW THE RE FORE.. in consideration of satisfying said require-
ment of the party of the second part, the party of the first part does hereby
grant, bargain, sell, convey, warrant and confirm unto the said party of the
second part, and to its successors and assigns.. all right, title and interest
in and to the following described real estate, situated in the County of Gallatin..
and State of Montana, to-wit:
Lot Twelve (12) of'tleveland Subdivision',' a suburb to Boze man.
Mon lana.. said Subdivision being located in the Southeast Quarter
(SE 1/4) of the Northwest Quarter (NW1/4)of Section Twelve (12)
Township Two (2) South. Range Five (5) East, M. P. M... according
to the official plat thereof on file and of record in the Office
of the Clerk and Recorder of Gallatin County, Montana.
TOGE THE R. with all and singular the tenements, he reditaments,
and appurtenances thereto belonging or in any wise appertaining.
And the said party of the first part and her heirs.. does hereby
covenant that they will forever WARRANT and DEFEND all right, title and
interest in and to said premises and the quiet and peaceable possession there-
of.. unto the said party of the second part, and to its successors and assigns,
against all acts and deeds of the said party of the first part, and all and every
person and persons whomsoever lawfully claiming or to claim the same.
IN WITNESS WHEREOF" the said party of the first part has here-
unto set her hand and seal the day and year first hereinbefore written.
