HUBBER and SOLOMA. E. HUBBER, husband and wife, KNUTE WAHL and CHRISTINE WAHL,
husband and wife, MAURICE E. HENDERSON and GRACE A. HENDERSON, husband and wife,
BETA RHO of SlOMA CHI HOUSE COMPANY, a corpor4tion organized and existing under
and by virtue of the laws of the State of llontana, and llONTANA STATE COLLEGE
STUDEN'l' HOUSING ASSOClA':(.ION (Unit B), a corporat1o~organized and existing under
and by virtue of the laws of the State of Montana, all of Bozeman, Gallatin
County, Montana, the parties of the firtlt part, and THE CITY OF BOZEMAN, a
municipal corporation in Gallatin County, Montana, the party of the second part;
WIT N E SSE T H:
THA-T WHEREAS, the parties of the first part are owners of property on the
West. side of South Tracy Avenue between 'West College Street and West Dickerson
Street, in the City or Bozeman, Montana; and
WHEREAS, no public alley now exists in a portion of said block; and
WHEREAS, desiring to avail themselves at the benefits and advantages of a
public alley in the rear of their respective properties hereinafter described,
the said parties of the first part desire to transfer and convey unto the City
of Bozeman ten (10) feet off of the .rear,of their. respective properties herein-
after desoribed.
THEREFORE, in consideration of the premises and the BUlll of One Dollar ($1.00),
lawful money of the United States, in hand paid to the parties of the first part
by the party of the second part, the receipt of lIhich is hereby aCknowledged, the
parties of the tiratpart do hereby oonvey, remise, release, and forever quitclaim
unto the said party at the second part and to its 8uccessors and assigns, the
f'ollowi.ng described real estate situate in the City or Bozeman, County of Gallatin,
state of Montana, the same being a portion of their respective properties:
A tract of land ten (10) feet in width located in Block Seven (7)
of the Fairview Addition to Bozeman, Montana, and more partiCUlarly
described as follows:: Beginning at the Southwest Corner of Lot
Twenty-one (21) of said Block Seven (1), thence Northerly along the
West lines of Lots Twenty-one (21) and Twenty (20) ot said Block
Seven (1) a distance of sixty (60) teet to the Northwest Corner ot
said Lot Twenty (20); thence Westerly along the Westerly prolon-
gation ot the North line of sa1dLot THnty (20) a distance otten
(10) feet, more or less, to a point on the center ltne of the alley
vacated by Ordinance No. 265 passed by the City Council of the City
of Bozeman on March 3, 1904; thence Souther).y along the center line
of said vacated alley a distance of e1xtiy (60)reet, more or less,
to an intersection with the Westerly prolongation of the South line

WHEREAS, this Corporation is the owner of property on the East
side of South Willson Avenue between West College and I~st Dickerson
in the City of Bozeman, Montana; and
\ffiEREAS, no public alley now exists in the portion of said block
upon which this Corporation's property abuts on the rear; and
'iVHEREAS, the other property owners whose property abuts on the
portion of said block in which there is no public alley desire that
a public alley be opened and desire to avail themselves of the bene-
fits and advantages of a public alley; and
\~IEREAS, it will be necessary in order for said alley to be
opened that this Corporation deed to the City of Bozeman ten (10) feet
off of the East end of its property; and
'iffiEREAS, it appears to be for the best interests of this Corpora-
tion that it convey ten (10) feet off the East end of its property
for the purpose of a public alley.
NOW, THEREFORE, BE IT RESOLVED that inconsideration of the
benefits and advantages to be gained by this Corporation from the
opening of a public alley in the rear of its premises, that this
Corporation do sell, transfer and convey unto the City of Bozeman
ten (10) feet off of the East end of its property in Block Seven (7),
of the Fairview Addition to Bozeman, Montana, and in Block "A" of
Alderson's Amendment to said Fairview Addition, the same being more
particularly described as follows:

this Corporation, be, and th~y are hereby authorized to make and exe-
~ute a Quit Cl~im Deed for and on behalf of this Corporation t~ans-
ferring the same to said City of Bozeman.

I, Edwin Howard, the duly elected, qualified and acting Secretary
of Beta Rho of Sigma Chi House Company, a Montana corporation, do hereby
certify that the foregoing is a true and correct copy of a Resoluation
unanimously passed and adopted by the Board of Directors of Beta Rho of
Sigma Chi IL)use Company at a special meeting thereof held on June 8, 1955,
at which a quorum -of said Board of ,Directors was present and voting.
