RECOMMENDATION: Authorize City Manager to sign the Impact Fee Payment Agreement
with Capstone Collegiate Communities LLC for South University
District/Cattail Creek Drainage Basin Sanitary Sewer improvements to be
installed in Lincoln Street, Willow Way, and South 14th
Avenue.
BACKGROUND: Attached is a copy (original to City Clerk) of the City of Bozeman Impact
Fee Payment Agreement for improvements to trunk sewer in Lincoln
Street, Willow Way, and South 14th
Avenue. Engineering and Legal staff
developed the proposed agreement in conjunction with the Developer,
Capstone Collegiate Communities, LLC, who executed the agreement and
returned it to the City for signature by the City Manager. Funds for
improvements to the South University District/Cattail Creek Drainage
Basin Sanitary Sewer are in the approved capital improvements program
as wastewater impact fee project number WWIF27 in Fiscal Year 2018.
Per the attached agreement, the Developer will construct and pay for the
Developer’s portion of the improvements, and the remainder of the
improvements to the trunk sewer will be paid from the wastewater impact

fee funds in WWIF27. The Developer will not be reimbursed until the
project is complete.
FISCAL EFFECTS: Defined in the approved Wastewater Impact Fee item WWIF27 in
the Capital Improvements Program and in the attached agreement.
ALTERNATIVES: As suggested by the City Commission.
