SUBJECT: Authorize City Manager to sign Memorandum of Easement Agreement
and Public Use Easements and Temporary Construction Easements
with George E. Westlake and D.K. Martinen LLC for the 5th Avenue
Multi-Use Path.

RECOMMENDATION: Authorize the City Manager to sign the easements and
memorandum of easement agreement.
BACKGROUND:
The Midtown Action Plan and the Transportation Master Plan prescribe a mixed-use
path in the 5th Ave. right-of-way from Oak St. to Tamarack St. While right-of-way exists for
a local street section in this area, installation of a multi-use path requires additional right of
way. Construction of the proposed path would occur in place of a standard sidewalk on the
east side of the right-of-way. The new path would provide for safer multi-model
connectivity adjacent to the N. 7th Ave. corridor, especially in the absence of a local street
between Oak St. and Hemlock St.
UNRESOLVED ISSUES: None.
ALTERNATIVES: As determined by the City Commission.
FISCAL EFFECTS:
The cost of the easement is $10. Additionally, the City is required by the terms of the
memorandum of easement agreement to cover maintenance costs for the path and to
construct a wire fence adjacent to easement. The cost of constructing the path
improvements would be included in a future Work Plan and Budget request for the
Midtown Urban Renewal District.
