SUBJECT: Approve a Beer and Wine License for 400 Bozeman Beverage LLC of
Bozeman, Montana to sell Beer and Wine at 10 W Main St also known as the
Rialto.

RECOMMENDATION: Approve a Beer and Wine License for 400 Bozeman Beverage LLC of
Bozeman, Montana to sell Beer and Wine at 10 W Main St also known as the
Rialto.
BACKGROUND: Sec. 4.02.030. - City license required; application; license fees.
A. No person shall manufacture or sell alcohol in the city, under the provisions of the Montana
Alcoholic Beverage Code, or at all, without first procuring a license to do so from the city.
B. The application shall be filed with the city clerk and presented for the consideration of the
commission. The commission may, in its discretion, postpone any action for investigation or other
good cause. The action of the commission with reference to the application shall be recorded in the
meeting's minutes.
C. If the application is rejected, the reasons must be noted in the minute entry, the applicant
notified, and the tendered fee returned.
D. License fees must be payable in advance and shall accompany the application therefore,
whether original or renewal. All licenses under this article will expire at 12:00 midnight of
December 31, in the year for which such license is issued. In the event that a license is granted after
June 30 of any year, the license fee will be one-half of the entire yearly license.
The applicant has obtained a temporary Beer and Wine License from the Montana Liquor Control
Board and approval of temporary operating authority through March 8, 2018. It is license number 06-
715-6377-311. Final approval of this license should be granted prior to March 8, 2018. If final
approval is not granted, this license will be revoked.
FISCAL EFFECTS: Accept payment of $400.00 for calendar year 2018 to allow them to sell alcohol

upon approval.
ALTERNATIVES: As suggested by the City Commission.
