ORDINANCE NO. 1661
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT ANA, AMENDING THE CITY OF BOZEMAN ZONE MAP BY ESTABLISHING
AN INITIAL ZONING OF "R-4," (RESIDENTIAL-HIGH-DENSITY DISTRICT) FOR
42.18 ACRES LOCATED IN THE SOUTHWEST ONE-QUARTER OF SECTION 26,
TOWNSHIP 1 SOUTH, RANGE 5 EAST, PRINCIPAL MERIDIAN MONTANA, CITY
OF BOZEMAN, GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment to amend the City of Bozeman Zone Map by
establishing an initial zoning of "R-4" (Residential High-Density District) for 42.18 acres and adjacent right-
of-way, has been properly submitted, reviewed and advertised; and
WHEREAS, the Bozeman Zoning Commission held a public hearing on November 1, 2005, to
receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission
that the zone map amendment be approved only if the zoning is changed to match their proposed master
plan; and
WHEREAS, after proper notice, the City Commission held its public hearing on November 21,
2005, to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
established in Section 76-2-304, M.C.A., and found the proposed zone map amendment to be in
compliance with the twelve criteria; and
WHEREAS, at its meeting held on November 21, 2005, the City Commission found that the
proposed zone map amendment would be in compliance with Bozeman's adopted growth policy and
would be in the public interest, upon annexation of the subject property; and
WHEREAS, the subject property was annexed through adoption of Commission Resolution No.
3897, adopted on the 6th day of March 2006.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described property is hereby designated as
"R-4" (Residential High-Density District):
Beginning at the southwest corner of said Section 26; thence North 00039'36" East,
along the west line of said section, a distance of 1519.09 feet to the southwest corner
of Tract A of Certificate of Survey No. 165A; thence North 50019'48" East, along the
southerly line of said tract, a distance of 186.40 feet; thence North 88050'19" East,
along said southerly line, a distance of 35.00 feet to the southwest corner of Lot 2 of
said subdivision; thence in a generally southeasterly direction along the southerly line
of Lot 2 through the following eight courses:
South 54018'36" East, a distance of 38.69 feet;
South 58029'41" East, a distance of 279.10 feet;
South 69009'35" East, a distance of 102.36 feet;
North 89057'49" East, a distance of 91.39 feet;
South 80000'30" East, a distance of 92.34 feet;
North 89044'04" East, a distance of 34.32 feet;
South 58019'50" East, a distance of 667.84 feet;
North 89044'54" East, a distance of 91.55 feet to the northwest corner of Lot 4 of Minor
Subdivision No. 221 C; thence South 00048'36" West, along the west line of said lot and along
its southerly extension, a distance of 1061.68 feet to a point on the south line of said Section
26; thence South 89044'54" West, along said south line, a distance of 1422.61 feet to the Point
of Beginning.
The described parcel contains 44.888 acres, more or less.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading at a regular
session thereof held on the 6th day of March 2006.
