of voice for the record. This is the time for individuals to comment on matters falling within the purview
of the Committee. There will also be an opportunity in conjunction with each action item for comments
pertaining to that item. Please limit your comments to three minutes.
E. Action Items
1. 17187 Starner Annexation – ZMA (Saunders)
The proposed amendment will establish an initial zoning designation of B-2, Community Business District, on
2.2 acres at the NW corner of Campbell Road and Frontage Road (US10) in association with annexation of the
property.
06:04:59 PM (00:05:02) Planner Chris Saunders, representing Community Development, described the
project location, proposed zoning and surrounding zoning of adjacent lots. He provided detail of the growth
policy future land use designation. The associated Annexation will be considered by the City Commission
and not the Zoning Commission.
06:06:49 PM (00:06:52) Criteria established by state law and local ordinance were reviewed by Staff, and is
detailed in the staff report. Staff found this project positively for all criteria but one that was found neutral.
06:07:34 PM (00:07:37) No public comment had been received at the time of this presentation. The
Development Review Committee found no barriers to approval of this project. Staff recommends approval of
the application as submitted.
06:08:08 PM (00:08:11) Board Member Thompson asked if the access to the site would be taken from Campbell
Road or Reeves Road. Saunders confirmed that was the case.
06:08:23 PM (00:08:26) Commissioner Mehl confirmed with Saunders that residential is a permitted use in the
B-2 zone (proposed zoning). Mehl inquired whether there should be a waiver of park maintenance as a condition
of approval. Saunders said it could be done as part of the annexation but would not be applicable to the zoning.
A discussion of why this would be of benefit was carried out between the Board Members.
06:09:37 PM (00:09:40) Chris Budeski of Madison Engineering, applicant’s representative, gave a brief
description of the application and why B-2 zoning was proposed.
06:10:30 PM (00:10:33) Mehl asked if the applicant could explain in more detail why this application was being
brought forward.
06:10:45 PM (00:10:48) Tom Starner, 404 Cornell Drive, applicant, gave an explanation of why this application
has been brought to the city and his anticipated vision for the site and anticipated use.
06:12:49 PM (00:12:52) Mehl inquired about site access and if Frontage Road would become a full intersection.
Saunders responded that Campbell Road is a full access road and MDT controls Frontage Road so it would be
their decision to alter it.
06:13:26 PM (00:13:29) No public comment.
06:13:52 PM (00:13:55) MOTION: Board Member Morice: “Having reviewed and considered the staff report,
application materials public comment and all the information presented, I hereby adopt the findings presented
in the staff report for Application 17187 and move to approve the Starner Zone Map Amendment with
contingencies required to complete the application process”
06:14:15 PM (00:14:18) MOTION SECONDED: Board Member Thompson.
06:14:19 PM (00:14:22) Morice commented on his motion and stated that he believes it makes sense and he has
no issue with this application.
06:14:47 PM (00:14:50) VOTE: All in favor: Motion carried unanimously.
06:14:55 PM (00:14:58) This will be on the City Commission agenda with the associated annexation on
November 20, 2017.
2. 17271 Flanders Mill Zone Map Amendment (Saunders)
The proposed amendment will change the zoning on approximately 3.7 acres of an existing lot from R-
3 Residential Medium Density to R-4 Residential High Density, and to rezone approximately 0.07 acres
of the same lot from R-4 Residential High Density to R-3 Residential Medium Density. The property is
generally located southeast of the intersection of East Baxter Lane and Flanders Mill Road. The
property is legally described as a portion of Lot 1R-4, Flanders Mill Subdivision phase 4 located in the
E ½ of the W ½ of Section 3, Township 2 South, Range 5 East, P.M.M., City of Bozeman, Gallatin County,
Montana, 59718
06:15:35 PM (00:15:38) Planner Chris Saunders, representing Community Development, described the
project location, proposed zoning and surrounding uses of adjacent lots. He provided detail of the
proposed zoning designation change amendment and the reason for the application, as well as the
growth policy future land use designation. The Flanders Mill subdivision is an approved subdivision on
this project area.
06:18:45 PM (00:18:48) Criteria established by state law and local ordinance were reviewed by Staff, and is
detailed in the staff report. Staff found this project positively for all criteria but one that was found neutral.
06:19:22 PM (00:19:25) No public comment had been received at the time of this presentation. The
Development Review Committee found no barriers to approval of this project. Staff recommends approval of
the application as submitted. This application will be presented to the City Commission on November 20, 2017.
06:19:46 PM (00:19:49) Saunders stated that this application is for Phase 7 of Flanders Mill, in response to Board
Member Morice’s question. Saunders expects that this phase would be platted by the coming summer (2018)
and described the future development plans of the subject area.
06:22:39 PM (00:22:42) Board Member Thompson asked where the nearest business zoning areas are to the
subject property. Saunders showed on a map where the two closest areas are (small commercial node on
Cottonwood near Babcock, and at the intersection of Baxter and Davis). Thompson stated there were no
potential business areas zoned adjacent or close to the high school or the park. Morice contributed to
identifying the commercial nodes nearby.
06:25:01 PM (00:25:04) Scott Bechtle of Bechtle Architects described the purpose of this zone map amendment
application.
06:25:43 PM (00:25:46) Commissioner Mehl asked Bechtle if he has read the staff report and if he had any
concerns or found any problems with what was written. Bechtle stated that they are OK with the staff report.
06:25:56 PM (00:25:59) No public comment.
06:26:09 PM (00:26:12) MOTION: Board Member Thompson: “Having reviewed and considered the staff report,
application materials public comment and all information presented, I hereby adopt the findings presented in
the staff report for Application 17271 and move to approve the Flanders Mill Zone Map Amendment with
contingencies required to complete the application process”.

06:26:41 PM (00:26:44) Thompson spoke to his motion, stating that he believed it was the best use at this time
for the parcel.
06:26:51 PM (00:26:54) VOTE: All in favor: Motion carried unanimously.
F. FYI/Discussion
06:27:22 PM (00:27:25) Mehl explained there was a noticing question about the UDO reform and that this board
will be noticed as far in advance as they can because a quorum is needed.
06:28:02 PM (00:28:05) Morice asked if the amendments and changes from the architectural group were being
considered. Mehl confirmed they were being looked at and described what review actions had been taken by
Staff and himself. He estimated when Section 5 would be reviewed at the Commission meeting.
06:29:26 PM (00:29:29) In a response to Morice’s question, Saunders explained the process that is followed
when public comment is received by staff.
06:30:47 PM (00:30:50) Thompson stated he is challenged with the scarcity of business-type zoning around the
new high school and large park being created. He asked what opportunities there are moving forward as far as
zoning changes. Saunders stated there is a large parcel to the north and west of the high school site that has yet
to be annexed in to the City and there are subdivided but vacant lots immediately to the west of the future high
school zoned Residential Office which could be amended.
06:31:42 PM (00:31:45) Thompson suggested that this board pay attention to those opportunities. Mehl
engaged in the discussion and included where he believes the most opportunities are around the new high
school. Chair Garberg expressed his opinion that the market will start to recognize the opportunities around this
site.
06:33:04 PM (00:33:07) Thompson stated again that he wants the board to push to have a commercial district of
some type with ground-floor commercial close to the high school to alleviate transportation loads around the
neighborhoods.
06:34:14 PM (00:34:17) Saunders explained the relationship between the City and the School District and its
agency direction in a follow-up response to Morice’s intent to discuss the Emerson RFP. Garberg added to the
discussion of zoning and the School Board’s regulatory relationship with the City.
