ORDINANCE NO. 1651
. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP FROM R-S
(RESIDENTIAL SUBURBAN DISTRICT) TO R-1 (RESIDENTIAL-SINGLE-
HOUSEHOLD, LOW-DENSITY DISTRICT) ) ON APPROXIMATELY 84 ACRES
SITUATED IN THE SW%, SECTION 34, T1S, R5E, PMM, CITY OF BOZEMAN,
GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment to amend the zoning designation from "R-S",
(Residential-Suburban) to "R-1 " (Residential-Single-Household, Low-Density District) on approximately
84 acres has been properly submitted, reviewed and advertised; and
WHEREAS, the City of Bozeman Zoning Commission held a public hearing on June 21, 2005,
to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City
Commission that the zone map amendment be denied; and
WHEREAS, after proper notice, the City Commission held its public hearing on July 18, 2005,
to receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
. established in Section 76-2-304, M,C,A., and found the proposed zone map amendment, to be in
compliance with the twelve criteria; and
WHEREAS, at its meeting held on July 18, 2005, the City Commission found that the proposed
zone map amendment would be in compliance with the Bozeman 2020 Community Plan and would be
in the public interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described property is hereby established as
"R-1" (Residential Single-Household, Low Density District):
A portion of Lot 1, Block 7 and portions of Riata Road and Equestrian Lane of the
Final Plat of Baxter Meadows Subdivision P,U,D, Phase 1; a portion of Tract 1Aofthe
Amended Plat of Baxter Meadows Subdivision P,U,D, Phase 1, Tract 1; and a portion
of the Remainder of Tract 2A of Certificate of Survey No, 2202A, all located in the
Southwest Quarter of Section 34, Township 1 South, Range 5 East, Principal Meridian
Montana, City of Bozeman, Gallatin County, Montana:
. Commencing at the west quarter corner of said Section 34; thence South 00024'08"
West, along the west line of said section, a distance of 665,78 feet to the northwest
corner of said Tract 1Aand the Point of Beginning; thence North 89051'39" East, along

the north line of said Tract 1A, a distance of 2254,50 feet; thence South 00.18'15"
East, a distance of 294,78 feet; thence South 89041'28" West, a distance of 318.39
. feet; thence North 63.08'36" West, a distance of 70.54 feet to the point of curvature
of a curve to the left, having: a radius of 800,00 feet, a central angle of 26.41'43", a
chord bearing of North 76029'28" West and a chord length of 369,37 feet; thence along
the arc of said curve an arc length of 372,74 feet; thence South 00.24'33" West, along
the west line of Private Open Space C of the Final Plat of Baxter Meadows
Subdivision P,U,D, Phase 1 and along the northerly extension of said line, a distance
of 530.46 feet to the southwest corner of said Private Open Space C; thence North
89.52'19" East, along the south line of said open space, a distance of 47,38 feet to the
northwest corner of Lot 2 of said plat; thence South 00.01'11" East, along the west line
of said lot and along the southerly extension of said line, a distance of 264,82 feet;
thence North 89.58'49" East, a distance of 293,14 feet to the centerline of Riata Road;
thence along a non-tangent curve to the right, having: a radius of 550,00 feet, a
central angle of 32.14'44", a chord bearing of South 03017'57" West and a chord
length of 305.47 feet; thence along the arc of said curve and said centerline an arc
length of 309.54 feet to a point on the centerline of Equestrian Lane; thence South
78.23'34" East, along said centerline, a distance of 148.20 feet; thence South
00.18'05" West, along the west line of Lot 13, Block 5 of said plat and along the
northerly extension of said line, a distance of 146.82 feet to the southwest corner of
said Lot 13; thence North 89.41'17" East, along the south line of Lots 13 and 12 of
said plat, a distance of 240.03 feet to the southeast corner of said Lot 12; thence
North 00.19'34" East, along the east line of said lot and along the northerly extension
of said east line, a distance of 136,71 feet to a point on the centerline of Equestrian
Lane; thence North 89.41 '57" East, along said centerline, a distance of 34.01 feet;
thence South 00.18'49" East, along the west line of Lots 5 through 11 (in reverse
. order) of said Block 5, and along the northerly and southerly extensions of said west
line, a distance of 679,00 feet to the south line of Section 34; thence South 89.50'30"
West, along said section line, a distance of 1607,05 feet to the southeast corner of a
plat recorded on Page 207 of Book 148 of the Gallatin County Records; thence North
07.02'15" West, along the east line of said plat, a distance of 248,95 feet to the
northeast corner of said plat; thence South 89.46'08" West, along the north line of said
plat and along the north line of Tract 5 of Certificate of Survey No, 2202, a distance
of 632,51 feet to a point on the west line of Section 34; thence North 00.24'08" East,
along said line. a distance of 1750,28 feet to the Point of Beginning,
The described parcel contains 84,15 acres, more or less.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading,
